15 17-02-20251. The Learned counsel for the petitioner has relied on a judgment in Swarn Singh and Anr. v. State of Punjab and Ors. reported AIR 1976 SC 232. On perusal of the said judgment, it appears that the Apex Court has relied on a judgment in Syed Yakoob vs. K.S. Radhakrishnan and Ors. reported in 1964 AIR 477, but the said citation is not placed before this Court for perusal.
