ORDER
1. The Appellant filed an RTI application dated 23.12.2021 seeking information through 7 points in the following manner:
1. "यह क वष 2019 के खरीफ सीजन क फसल का पी०एन०बी० झाँसी के ब को दवारा ीिमयम काटने के बाद कसान का डाटा धानमं#ी फसल बीमा योजना (PMFBY) पोट ल पर दज नह% कये जाने से कसान क न& फसल 'ितपू*त हेतु ,ीमान म-डलायु. महोदय झाँसी म-डल झाँसी / िजलािधकारी कृ िष सां1यक िनद2शक 4ारा कसान क 'ितपू*त के स5ब6ध म7 पी०एन०बी० झाँसी को जारी आदेश , एवं उ. करण के स5ब6ध म7 'ितपू*त हेतु शासन- Page 1 of 4
शासन 4ारा जारी अ6य सभी आदेश व PNB को जारी आरसी क स>यािपत छाया ित उपल@ध करवाय7।
2. यह क उन सभी कसान क स>यािपत सूची उपल@ध करवाये िजनका पी०एन०बी० शाखा रे वन दुवारा वष 2019 म7 खरीफ सीजन का ीिमयम काटने के पCात् कसान का डाटा धानमं#ी फसल बीमा योजना (PMFBY) पोट ल पर दज नह% कया जा सका था।
3. यह क वष 2019 के खरीफ सीजन क फसल बीमा का डाटा धानमं#ी फसल बीमा योजना (PMFBY) पोट ल पर दज करने हेतु PMFBY पोट ल खुलने क ारं िभक ितिथ एवं अि6तम ितिथ के िववरण साFय सिहत स>यािपत छाया ित उपल@ध करवाय7 ।
4. यह क पी०एन०बी० शाखा रे वन म7 वष 2019 के खरीफ सीजन का ीिमयम काटने के पCात् ब क 4ारा िजन कसाना का डाटा PMFBY पोट ल पर डाटा अपलोड नही कया गया था। ऐसे KCC खाताधारक को पोट ल ब6द होने क ितिथ से पूव उनका डाटा PMFBY पोट ल पर दज नह% कये जाने क कारण सिहत ब क 4ारा जारी क गई अिधसूचना के साFय क स>यािपत ित उपल@ध करवाये ।
5. यह क पी०एन०बी० शाखा रे वन म7 वष 2019 के खरीफ सीजन क फसल बीमा का डाटा धानमं#ी फसल बीमा योजना (PMFBY) पोट ल पर दज करवाने हेतु उJरदायी अिधकारी का नाम एवं पदनाम उपल@ध करवाये।" etc.
2. Aggrieved with the non-receipt of any reply from the CPIO, the Appellant filed a First Appeal dated 31.01.2022. The FAA vide order dated 22.02.2022 observed that the delay in providing the reply to the Appellant was owing to the time taken in collation and Page 2 of 4 collection of inputs and thereby directed the CPIO to provide the reply within 3 days of the date of order.
3. Subsequently, in compliance with the FAA's order, the CPIO replied vide letter dated 23.02.2022 stating as under:-
1. "वष 2019 खरीफ़ सीजन के स5ब6ध म7 पी.एम.एफ.बी.वाई. के पोट ल पर कसान का डाटा दज नह% करने स5ब6ध म7 काया लय िजलािधकारी, झांसी 4ारा जारी कोई वसूली माण प# आज तक ब क को ाM नह% Nआ है, शेष सूचना िनCायक नह% होने के कारण अदेय है।
2. अपीलाथP 4ारा चाही गई सूचना, सूचना का अिधकार अिधिनयम, 2005 के अंतग त तृतीय प'कार क Qि.गत सूचना से स5बि6धत है, िजसके कटन से ना तो Rमशः िवTतृत लोकिहत का समथ न होता है और ना ही इस कटन से लोकिहत का कोई स5ब6ध है, तदनुसार िवषयगत सूचना, सूचना का अिधकार अिधिनयम, 2005 क धारा 8(1) (डी), 8(1) (ई) एंव 6(1) (जे) के अंतग त देय नह% है" ।
3. वष खरीफ-2019 हेतु धानमं#ी फसल बीमा योजना हेतु पोट ल थमतः 01.08.2019 म7 16.08.2019, त>पCात 18.09.2019 तक त>पCात 09.10.2019 म7 14.11.2019 तक खोला गया था ।
4. वष खरीफ-2019 हेतु धानमं#ी फसल बीमा योजना म7 िजन कृ षको का खाना पोट ल पर अपलोड नह% Nआ था उस स5ब6ध म7 शाखा ब6धक ने टेलफ े ोिनक स5पक , प5फलेट और डु गडु गी िपटवा कर उनको सूचना दी थी।
5. पोट ल पर डाटा अपलोड करने का काय शाखा काया लय 4ारा कया गया था।" etc.
4. Aggrieved with the information provided by the CPIO, the Appellant approached the Commission with the instant Second Appeal dated 05.05.2022. Page 3 of 4
5. The Appellant remained absent during the hearing and on behalf of the Respondent, Dhirendra Kumar Shashi, AGM & CPIO attended the hearing through video conference.
6. The Respondent reiterated the reply provided to the Appellant.
7. The Commission after adverting to the facts and circumstances of the case, and perusal of records, observes that considering the cumbersome nature of the RTI queries and humongous data sought with respect to the personal information of various third parties, the reply provided by the CPIO incorporating factual answers; invocation of prescribed exemptions of the RTI Act and stating non-maintainability of data, wherever applicable requires no intervention.
8. The Appeal is dismissed accordingly.
Copy of the decision be provided free of cost to the parties.
