ORDER
Information sought:
The Appellant filed RTI Application dated 02.07.2020 seeking information on the following two points:
"Please arrange to provide the following required information/documents duly certified as per the provisions of INDIAN EVIDENCE ACT 1872 (Under Section 76) under the Right to Information Act, 2005 at the earliest. Ref: 1)Your Notification No. RSVT/Estt./Appts./2018 dated 19.01.2018
2)Your Notification No. RSV/Estt./T/2019 and RSV/Estt./NT/2019 dated 29.06.2019.
1) Names and designations of the interview committee members who interviewed candidates on 20.02.2018 for the post of Consultant held at Rashtriya Sanskrit Vidyapeetha, Tirupati.
2) Names and designations of the interview committee members who interviewed candidates on 18.12.2019 for the post of Finance Officer held at Rashtriya Sanskrit Vidyapeetha, Tirupati."
Having not received any information from the CPIO, the Appellant filed a First Appeal dated 19.08.2020, which has not been adjudicated by the First Appellate Authority as per available records.
Grounds for Second Appeal:
The Appellant filed a Second Appeal u/s 19 of the Act on the ground of non- receipt of information from the Respondent. Appellant requested the Commission to direct the CPIO to provide complete information sought for and take appropriate legal action against the Respondent.
Submissions made by Appellant and Respondent during Hearing:
The Appellant stated that he has not received any reply from the Respondent qua the instant RTI Application. He further stated that he was one of the candidates for Page 2 of 6 CIC/RSVID/A/2020/131400 the averred post of consultant and he wants the name and designation of the interview committee members as he was not selected for the said post.
The Respondent submitted that earlier no reply was given to the Appellant as it was a deemed university at the time of filing RTI Application and recently in the month of March, 2021, they have centralized CPIO and RTI System in the university. He further added that vide letter dated 18.03.2022, they have provided relevant information to the Appellant as sought in the RTI Application.
The Commission interjected and remarked the Respondent that providing names and designations of interview committee members is third party information which is exempted from disclosure under Section 8 of the RTI Act.
A written submission has been received by the Commission from Shri Krishna Rao Y. V., CPIO, National Sanskrit University, vide letter dated 18.03.2022 and the same has been marked to the Appellant, wherein the Commission has been apprised as under:Page 3 of 6
CIC/RSVID/A/2020/131400 Decision:
Upon perusal of the facts on record as well as on the basis of the proceedings during the hearing, the Commission observes that the Respondent has provided the names and designations of interview committee members to the Appellant which is personal information of third party exempted from disclosure under Section 8 (1)
(e) and 8 (1) (j) of the RTI Act and such lackadaisical conduct of the Respondent is not in accordance with the extant provisions of the RTI Act. The Commission strictly admonishes the Respondent for providing the same to the Appellant, without application of mind.
A copy of this order is marked to the Chancellor, Central Sanskrit University, Page 4 of 6 CIC/RSVID/A/2020/131400 to take note of the aberration of RTI Act being manifested in the Respondent public authority's office. The Vice Chancellor is directed to sensitize the officials dealing with the RTI matters, regarding the provisions of RTI Act by way of training workshops etc. and putting in place a coherent system of checks and balances.
With the above observations, the instant Second Appeal is disposed of. Copy of the decision be provided free of cost to the parties.
The Appeal, hereby, stands disposed of.
