Facts:
2. The appellant by RTI dated 09.05.2015 sought information with respect of supply of electricity connection, fixing of street lights etc., who gives the permission to supply of electricity connection and development work for electricity in Prem Nagar GI Block, Village Papravat, Najafgarh, New Delhi43. Sh. O.P. Taneja, Div. Head (O & M), BSES, 220 KV S/Stn Bldg. Power House, Najafgarh, New Delhi has given a reply to the appellant that "BSES do not fall within the definition of Public Authority under Section 2(h) of RTI Act, 2005 and mere a part of financial stake of the State Govt. in equity, would not make the Petitioner a public authority under RTI Act, 2005. In this context, BSES has stated that the company does CIC/SA/C/2015/000175 Page 1 not fall under purview of RTI Act. A case in Delhi High Court No. WPC No.544/2007 dated 23.01.2007 in the matter of BSES Rajdhani Power Ltd. Vs. the Central Information Commission & other is stated to have been pending." DECISION:
3. Complainant has filed RTI application against BSES whose fate as to public authority is pending before High Court. The Commission advices the complainant, to file his grievance/complaint about illegal power connection in Papravat, Najafgarh area, to the Electricity Department. The Commission also recommends the PIO, Electricity Department, Delhi Government to take into consideration the complainant grievance/complaint. With the above observations, complainant is closed.
