Heard learned counsels for the petitioner and the State.

The petitioner is apprehending his arrest in a complaint case in which cognizance has been taken for the offences punishable under Sections 406, 323 and 504 of the Indian Penal Code.

It is alleged that some land was sold by the complainant in favour of the petitioner and on the next day the petitioner got some money on promise to return, but the same was not returned and an agreement to that effect was also executed.

It is submitted by learned counsel for the petitioner that there is no proof with regard to the money and for the accusation of 2008, the complaint has been filed in 2011.

Considering the aforesaid facts, let the above Patna High Court Cr.Misc. No.26246 of 2012 (3) dt.02-08-2012 2/2 named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, East Champaran, Motihari in connection with Complaint Case No. C-1407 of 2011, Tr. No. 847 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
