Heard learned counsel for the parties. 

The petitioner is an accused in a case registered under  Sections   147/148/149/302/307/353/379/332/333/427   of   the  Indian Penal Code, Section 27 of the Arms Act, Sections 3/4 of  Explosive   Substance   Act,   Section   17   of   the   Criminal   Law  Amendment   Act   and   Section   13   of   Prevention   of   Unlawful  Activities Act, in connection with S.T. No. 123 of 2015, pending in  the court of learned Principal Sessions Judge, Latehar.

The learned counsel for the petitioner submits that the  petitioner has been falsely implicated in the present case only on  the   basis   of   the   fact   that   the   police   personnels   heard   the  miscreants calling the name of each other, wherein the name of  the petitioner was also taken. There is no more evidence except  the said fact. 

On   the  other  hand, the  learned AP.P. while  opposing  the   prayer   for   bail   refers   to   paragraph   no.   18   of   the counter­affidavit, wherein it has been stated that as per paragraph  no. 140 of the case diary, witness namely, Mansur Alam has stated  that he along with his friend Pankaj were returning from the river  through open field when saw some extremists coming from one  side and some extremists coming from the other side in which the  petitioner was also seen. The said witness claimed to have seen  the   extremist   group   along   with   the   petitioner   just   before   the  occurrence. There are two criminal antecedents also against the  petitioner. 

Considering the facts and circumstances of the case, I  am not inclined to enlarge the petitioner on bail and, hence, the  bail application of the petitioner is hereby dismissed.
