3. The instant Writ Petition under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 has been filed by the petitioner seeking issuance of writ in the nature of mandamus directing the respondent to release the petitioner on 1 st spell of furlough for three weeks.

4. Learned counsel for the petitioner submits that the petitioner has filed parole application on 05.05.2023 before the Competent Authority of the Signature Not Verified Digitally Signed By:ZEENAT PRAVEEN Signing Date:13.05.2023 15:39:48 respondent to re-establish social ties with society and family members on account of continuous long incarceration. However, the respondent has failed to decide the parole application of the petitioner within the stipulated period of three weeks as mentioned in the Parole/Furlough Guidelines.

5. Issue notice. Ms. Rupali Bandhopadhya, learned ASC accepts notice on behalf of the State.

6. Having heard learned counsel for the parties and having gone through the facts averred in the present petition, this Court directs the respondent to expeditiously decide the application filed by the petitioner within two weeks under intimation to the petitioner.

7. Petition is disposed of accordingly.

8. The order be uploaded on the website forthwith.
