JUDGEMENT
This is a petition filed by the petitioner U/s.12 of Protection of Women from Domestic Violence Act, 2005 seeking relief's U/s.18, 19, 20 and 22 of the said Act.
2. The case of the petitioner in brief is as under:
It is the case of the petitioner that she was married to respondent on18-01-2012 at the petitioner's residence at Basavanagudi, Bangalroe as per Hindu Rites and Customs. The marriage was subsequently registered on the same day. A reception was hosted on 19-01-2012 at Pai Vista Cnvention Hall, Basavanagudi, Bangalore. The petitioner No.2 and 3 are the father-in-law and mother-in-law. The petitioner herein was earlier married to one Sri Nagesh and having gone through a traumatic marriage had initiated proceedings for divorce during the year 2010. At such time sometime during the month of May 2010 the respondent No.3 through some common relatives having come to know of the petitioner and her family members had got in touch with the petitioner's uncle with a proposal to get the petitioner married to a son having claimed that her son, there No.1 herein who was also married to one Smt. Shilpa and that her son had also initiated 3 Crl.Misc.No.89/2013 proceedings for divorce and that she was interested in getting the petitioner married to her son who would soon be obtaining divorce. That though the petitioner had her family members were initially reluctant about the same as both the petitioner and respondent No.1 were yet to obtain divorce and as such the petitioner and her family members had clearly put forth to the respondent No.3 that they would not be able to think of the petitioner getting remarried until sh had actually obtained her divorce and until the respondent No.1 had also obtained divorce, to which the respondent No.3 had persuaded them by stating that both sides would only agree on the marriage for present and had assured that the marriage would take place only after both sides had obtained divorce. That in due course of time the respondent No.1 had met the petitioner and expressed his interest and willingness to get married to the petitioner and that indue course of time the petitioner had obtained a divorce from her earlier husband during the month of December 2010 and that subsequently the respondent No.01 and 03 had communicated to the petitioner and her family members that the respondent No.1 had also obtained hils divorced during the end of February 2011. That as both the families had bonded well in the mean time the pejtitoner's family did not find it necessary to verify if the respondent No.1 had really obtained ja divorce and that the petitioner and respondent had gotmarried iln a tradiltional ceremony at the petitioner's residence at Bangalore on 6th March 2011. However with a couple of days pursuant to the said marriage the petitioner had been ifomred by a family friend that the 4 Crl.Misc.No.89/2013 respondent No.1 had not yet obtained divorce from his earlier wife, much to the shcok and dismlay of the petitioner and the petitioner as such had stayed back at her parental home only making clear to the respondent No.1 that they would live together only after they were legally married. That within fewdays of the said marriage, the respondent No.1 had demanded the petitioner to arrange for a sum of rupees ten lakhs and that the petitioner at such time had managed to arranged a sum of five lakhs from her family members of which three lakhs was paid by way of cheque and the remaining sum of rupees two laksh was paid by way of cheque and the remaining sum of rupees two lakhs was paid by way of cash. In due course of time the respondent No.1 and left to United Kingdom on work during the 1st week of May 2011 and subsequently the respondent No.1 having arranged for the petitoner's visa trhough his cousin had forced the petitioner to make a trip to United Kingdom during the month of August 2011. However much to the dismlay of the petitioner after a few days of the petitioner visiting the respondent at UK the respondent No.1 had come to India leaving the petitioner alone in an alien land for over two weeks. That the respondent No.1 had filnally obtained a divorce during such time but however there was a drastic change iln the behaviour of the respondent No.1 on obtaining a divorced from his first wife. Subsequently the petitioner and respondent No.1 had got married at the petitioner's residence on January 18th 2012 and the marriage was registered on the same day and a reception was hosted by the petitioner's father on the following day in a grand manner 5 Crl.Misc.No.89/2013 having incurred substantial expenses. That the respondent No.1 sister had come down from Australia for the wedding and the respondent No.1's sister had been sowing seeds of gatred in the mind of the respondent No.1 about the petitioner from the very day of the marriage. With two days of the marriage the respondent No.1's sister had humiliated the petitioner in public much to the embarrassment and dismay of the petitioner. That the petitioner went to the matrimonial home on 21st January 2012. That on the very first day in the matrimonial home the respondent No.1 had gone away from home leaving the petitioner alone and had returned only late at night. That the petitioner in turn was made to do all household chores on the very first day and was not even offered water or food to eat. If the petitioner were to pick up a plate to eat the respondent No.1's sister had intentionally give the petitioner some chores to complete. That when the petitioner had tried to bring to the notice of the respondent No.1 about the harassment that she had been through, on the next day, the respondent No.1 had physically assaulted the petitioner only to add her dismay and had further forced her to sign papers stating that the respondents would in no way be held responsible if anything wer to happen to her, to which the petitioner had refused. That the respondent No.1 had left to UK on the same night. That the petitioner was asked to stay in her parents house by the respondent No.3 and her daughter until the respondent No.1 returns or until such time that the petitioner were to join the respondent No.1 at U.K. However the petitioner would be asked to come to the 6 Crl.Misc.No.89/2013 matrimonial home every morning do all the household chores and return late in the night to her parental home.The petitioner would be made to eat leftovers and would not even be permitted to rest for a while. That the respondent No.1's sister had left to Australia on 10th February and at such time even she had tried to coerce the petitioner to sign a paper stating that no one could be held responsible if anything were to happen to the petitioner and as the petitioner had failed to heed to her demand the respondent No.1's sister had staunchly told the petitioner that the respondent No.1 would not live with the petitioner anymore. That the respondent No.1 would constantly call the petitioner only to abuse her and humiliate her about her looks, her previous marriage etc., causing lot of dismay to the petitioner. That in due course of time by constant pleading of the petitioner the respondent No.1 had arranged for the petitioner's travel to U.K. Once the petitioner had reached U.K., the respondent No.1 had behaved in a very inconsistent manner. The respondent No.1 had seldom treatedj the petitioner with care and had often abused her physically and mentally. The respondent No.1 on several occasions had beaten up the petitioner leaving her badly brusied and battered. The respondent had subsequently taken the petitioner to his cousin's house where he had meted out the same kind of treatment to her. The respondent No.1 had beaten up the petitioner even in the presence of the respondent No.1's cousin and his wife. That the respondent No.3 simultaneously at the same time had been exerting pressure on the petitioner's family members to make the 7 Crl.Misc.No.89/2013 petitioner agree for divorce. That the petitioner and respondent No.1 had returned to India during the month of April 2012 and the respondent No.3 had refused to let the petitioner into the house and the petitioner had somehow managed to enter the matrimonial home. But however the respondent No.1 on the following day had managed to take the petitioner along with him and drop her at parent's house. Consequent thereupon the respondent No.1 had taken the petitioner to Chickmagalur about which the petitioner ecstatic only to realize that the respondent No.1 sole intention of taking her there was to convince her for a divorce and had asked the petitioner to stay back in India and not to travel along with him to U.K. However ad the petitioner had remained unrelenting the respondent No.1 having no choice had taken the petitioner along with him to Southampton on 26th May 2012. That the respondent No.1 havign gone to work in the morning on reaching U.K. had returned within a few hours only to state that he was not interested in the said job and that he intended to return India and had abused the petitioner all the way back to the airport and they had returned to India on 30th May 2012 and the petitioner was forced to go and reside along with her parents. The respondent No.1 would not even call the petitioner and would not even take the calls of the petitioner but instead was busy visiting places and attending his cousins wedding etc., when the petitioner's father had tried to call the respondent No.1 to sort out the matter the respondent No.1 had badly abused the petitioner's father. The petitioner had in the meantime learnt 8 Crl.Misc.No.89/2013 that the respondent No.1 was getting hospitalized to undergo piles operation and at such time had gone to the hospital to be with the respondent No.1 only to be advised even by the respondent No.1 and 2 to give her consent for divorce and not to shift to U.K. along with the respondent No.1. Thisbeing so during the month of July 2012 the respondent No.2 had surprisingly called up the petitioner asking the petitioner to come to the matrimonialhome for Varamalakshmi festival and the petitioner had accordingly gone there but there No.1 had been codl and unresponsible towards the petitioner. There No.1 had to travel to Manchester during the month of July 2012 and at such time when the petitioner had beggedand pleaded with the respondent No.1 that they should be staying together, the respondent no1. had taken her along with him. That during their stay at Manchester the respondent No.1 had often abused and tramatised the petitioner. At such time the petitioner had to her further agony seen the petitioner being unsually close with his cousin's wife and would often spend time with his cousin's wife by name Sowmya and had in fact stay overnight along with his cousin's wife when he cousin was out of U.K. The respondent No.1 very conniving would get the petitioner engaged and at such if the petitioner was to yell at him in fury record the conversations. At such time after getting the petitioner enraged and mad with fury the respondent No.1 would in stark contrast soon after try to be nice towards the petitioner. The petitioner at such time was totally at loss as to why the respondent No.1 would first enrage her by abusing her thereafter keep quite over the same 9 Crl.Misc.No.89/2013 or pretend by talking sweet words, which the petitioner now realized was a play of the respondent No.1 to create proof against this petitioner to obtain divorce, and it all appears to be pre planned. The respondent No.1 had often manhandled the petitioner and if the respondent No.1 were to get a few scratches in the melee of the petitioner trying to defend herself the respondent No.1 would make a hue and cry over the same and would even get doctor certificates to that effect. The petitioner whilst her stay at Manchester had conducted herself to the fullest satisfaction of the respondent No.1 and had celebrated the birthday of the respondent No.1 and had celebrated festivals and despite the same, the respondent No.1 had shown no sense of affection towards the petitioner but only continued to harass and traumatize the petitioner. The respondent No.1 had also failed to take care of the petitioner when she was unwell. That the petitioner haad required hospitalization when she had developed very painful boils on her fingers and even during such time the respondent No.1 had behaved in an inhuman manner much to the dismay of the petitioner and even the hospital staff had enquired with the petitioner if the respondent No.1 was actually taking good care of her and had asked her to report the matter toh te police if required. However the petitioner hoping that things would soon settle down and kept quite about the same. That with every passing the inhuman treatmenet meted out of the petitioner increased and the respondent No.1 had started speding most of his time either talking to hiscousin's wife or messaging or mailing her or would spend long hours at her 10 Crl.Misc.No.89/2013 place. The petitioner has all reasons to believe that the respondent No.1 and his cousin's wife shared more than just a friendly relationship. The respondent No.1 would often spends time drinking and would often force the petitioner to consume alcoholc much against her wishes. That the respondent No.1 even stopped speaking and sleeping in the same room as the petitioner and it was only on the repeated requests of the petitioner that the respondent No.1 had moved back into the same room with the petitioner. That during the month of December 2012 the respondent No.1 had picked up a fight with the petitioner and had tried to strangulate the petitioner and at such time in self defence the petitioner had pushed aside the respondent No.1 and the respondent No.1 had suffered a few bruises in the melee. That the petitioner was harassed to such extent that she was almost contemplating to end her life and had to write a mail to her relative explaining the anguish that she was been put to. At such time the respondent No.1 had called in the police home only to implicate the petitioner in a police case. Consequent there upon the petitioner and respondent No.1 had gone back home together and he sent me alone with the police and didn't even ring me when I reached home at 4.00 p.m. Consequent thereupon the petitioner had pleaded with the respondent No.1 to forget the past and lead a peaceful marital life and though the respondent No.1 would be with the petitioner in the same house he had remained totally detached from her and had only shown interest in sharing a physical relationship with her. Even on the repeated request of the petitioner to 11 Crl.Misc.No.89/2013 show some sense of affection the respondent No.1 had failed to do so. That on 14th February the respondent No.1 had taken the petitioner to a movie and the petitioner had really hoped that the respondent No.1 was now showing more affection towards her. However this being so the respondent No.1 within few days thereaftere had once again renewed his demands for divorce and started abusing and assaulting the petitioner. This being the state of affairs as the petitioner continued to put up with the errant behaviour of the petitioner, the petitioner very much to her shock had received a notice on proceedings for divorce initiated by the respondent No.1. The petitioner had thereupon learnt that the respondent No.1 had instituted proceedings on 14th of February before taking her for a movie. That there No.1 having got the notice served on the petitioner had asked her to leave the house and had thrown her out of the house and the petitioner with no place to go was forced to return to India. That the respondent No.1 has since been spreading baseless rumours against the petitioner. The respondent No.2 and 3 always instigate the respondent No.1 to harass the petitioner and to get dowry to buy a flat at Bangalore in the name of the respondent No.1. The petitioner told the respondent No.1 behaviour and harassment on the petitioner to the respondent No.2 and 3 for which they have not responded and advised the petitioner to ful fill the demands of the respondent No.1. The petitioner when she is staying with the respondent No.2 and 3 during her stay in India they are not providing proper food and treatment and further they areb laming and harassing the 12 Crl.Misc.No.89/2013 petitioner for not giving enough dowry to by her parents. That the respondents were always in the ahbit of threatening the petitioner only with an intention to subjugate the petitioner to meet their unreasonable demands. That the respondents has treated the petitioner with physical, mental and legal cruelty. That the respondents has treated the petitioner with physical, mental and legal cruelty. That the respondents are fully aware that they and his family have harassed and taken dowry from petitioner and has threatened and forced her to part with all her money. The petitioner has been a victim of domestic violence and dowry harassment and has been subjected to extreme acts of cruelty by respondents. The respondent is working for Wipro Technology LTd., in England and getting monthly income of Rs.3,58,000/- or 4,130 pounds p.m. by way of salary and now it has increased to 5,000 pounds p.m. and his also rents from the commercial complexes in Bangalore and his parents properties and also getting substantial income. The petitioner is not having any source of income to maintain herself. Now the respondent No.1 as a responsible husband, he has to maintain the petitioner and to provide shelter, food and clothing. The petitioner without any other alternative taking shelter and help of her parent's for her day to day life. The petitioner has neighter money nor any kind of support, the petitioner is not having any source of income to maintainherself. The petitioner has all along been subjected to domestic violence in the form of mental and economical abused by the respondents. Being a victim of domestic violence the petitioner has filed the said complainant 13 Crl.Misc.No.89/2013 due to all the above stated reasons. The petitioner has neither money nor any kind of support and the petitioner is not having any source of income to maintain herself. Due to the impact of accident the harassment of the respondent, the petitioner without any alternate the petitioner filed petition before the Family Court, Bangalore for divorce against the respondent No.1 bearing No.M.C.No.1144/2013 pendinbg in the file of Addl. Judge, Family Court, Bangalore which is peding. As such she prayed for a protection order U/s.18 and residence order U/s.19, monetary relief of Rs.16,00,000/-, compensation of Rs.5,00,00,000/- and maintenance of Rs.1,00,000/- p.m.
3. After registration of the case, summons was issued to the respondent No.1 to 3 and respondent No.1 placed exparte. Respondent No.2 and 3 have appeared through their counsel and filed detailed statement of objection denying each and every allegations made against them.
4. In order to substantiate their respective contentions, the petitioner got examined herself as P.W.1 and got marked 16 documents as Ex.P.1 to Ex.P.16. The respondent No.1 placed exparte himself and the respondent No.2 and 3 cross-
examined the P.W.1. The respondent No.2 got examined himself as R.W.1 and got marked 6 documents as Ex.R.1 to Ex.R.6.
5. Heard arguments on both the sides, perused the petition, objection and available materials on record.
14 Crl.Misc.No.89/20136. The following points would arise for my consideration.
1. Whether the petitioner is entitled for the relief's as sought in the petition?

7. On perusal of materials before this court, My findings on the above said points are as under:

POINT No.1: To file a petition U/s.12 of the Act, it is necessary that the petitioner has to establish two things firstly, she must establish that, the petitioner and respondent or respondents lived or are living together, in a domestic relationship. Secondly, that the respondent or respondents have subjected her to acts of domestic violence. To prove the domestic relationship the petitioner is required to prove that she and the respondents have lived together in a relationship of marriage or in a relationship in the nature of marriage or related by consanguinity or adoption or as family members living together as a joint family. To prove the act of domestic violence the petitioner is required o prove any one or more of the acts committed by the respondent or respondents as contemplated U/s.3 of the Act.
9. In the present case the petitioner got examined herself as P.W.1 and got marked 16 documents from Ex.P.1 to Ex.P.16.
15 Crl.Misc.No.89/2013Since the respondent No.1 is placed exparte the presumption regarding the marriage has not disputed. The respondent No.2 in his statement of objection has admitted that the marriage between the petitioner and respondent No.1 was solemnized on 18-01-2012. Hence the marriage between the petitioner and 1st respondent is not seriously contested.

CfðzÁgÀjUÉ £ÁªÀÅ ¤ÃrzÀAvÀºÀ vÉÆAzÀgɬÄAzÁV ¸ÀzÀjAiÀĪÀgÀÄ ¥Àæ¸ÀÄÛvÀ ¥ÀæPÀgÀtªÀ£ÀÄß zÁR°¹gÀÄvÁÛgÉ ªÀÄvÀÄÛ £ÀªÀÄUÉ AiÀiÁªÀÅzÉà vÉÆAzÀgÉ CfðzÁgÀjAzÀ DVgÀĪÀÅ¢®èªÉAzÀgÉ ¸ÀjAiÀÄ®è.
12. On perusal of these depositions it is clear that relationship between the petitioners and respondent is not in dispute. The petitioners have failed to prove the respondent has harassed them. However no specific allegations are being made against the respondents so as to prove the act of Domestic Violence. Mere allegations which are not specific and which are vague in nature cannot be accepted as proof of Domestic Violence.
13. The P.W.1 in her cross-examination admits that she being a BBM graduate has taken additional professional course in advanced diploma in cosmetology. P.W.1 further admits Ex.R.1 being order sheet of M.C. No.3605/10 which shows 37 Crl.Misc.No.89/2013 that the said petitioner was married to one Nagesh prior to marriage with the respondent No.1. The said marriage of petitioner with Nagesh came to be concluded by obtaining divorce with said Nagesh. The said divorce petition is marked as Ex.R.3. P.W.1 cleverly denies that she do not know about the case filed by her against the said Nagesh. This shows the conduct of the petitioner. Further P.W.1 admits that she was working in Convergies Institution prior to the marriage with respondent No.1 she do not remember how much salary was earned by respondent No.1 at that time. Even P.W.1 had worked in Converties Institution for 1½ year later she opened Neeru's Beauty Saloon at Jayanagar, Bangalore. She do not remember how much rent she used to pay for the said beauty parlour. But she denies that she is presently running the said parlour. Further P.W.1 voluntarily admits that if she receives any order for bridal make up contract she accepts the order and approximately charges about Rs.1,500/- to 2,000/- per order. She denies that she receives Rs.50,000/- per bridal make up charges.

P.W.1 further in her cross-examination by the learned counsel for the respondent admits that she has produced photographs of her marriage with respondent No.1 dt.18-01-2012, but she has not produced any photos to show that her marriage with respondent No.1 was solemnized on 06-03-2011. When learned counsel for the respondent questioned regarding the solenmnization of marriage between herself and respondent No.1 was not held on 06-03-2011, P.W.1 clearly denies the said suggestion.
38 Crl.Misc.No.89/201315. P.W.1 admits that she has not given any statement before any person regarding the said case. Which clearly shows that the petitioner has not given any statement before protection officer who has recorded her domestic incident report.
16. When such being the case, the infliction of domestic violence made against the respondents gets diluted and same cannot be accepted. The Protection of Women from Domestic Violence Act 2005 is beneficiary legislation and is intended to protect the interest of wife. In order to claim any relief under the said Act, must satisfy and prove before this Court that she is an aggrieved woman U/s.2(a) of the said Act and she has been subjected to domestic violence as defined U/s.3 of Domestic violence Act. Hence on perusal of the evidence of P.W.1 it establishes that except the vague allegations made against the respondent No.1, the petitioner has not proved her case of domestic violence against him.
17. It is the case of the petitioner that the 1st respondent being a able bodied man, who is financially sound has neglected her in taking proper care. However, in spite of receipt of notice the respondent No.1 has not come forward before this court denying or disproving the allegation made against him in this case. Hence, at this juncture there are no material furnished before this court to disbelieve the case of the petitioner. If the respondent No.1 had taken care of the petitioner he could have certainly put up some defence before this court against the claim of the petitioner. Apart from this on perusal of records it is found that no issues are born to both the 39 Crl.Misc.No.89/2013 petitioner and respondent No.1. Though the petitioner has not placed on record any evidence in relation to the act of Domestic Violence yet the interest of the petitioner is to be looked into. Hence, in the absence of evidence in relation to Domestic Violence this court is of the opinion that granting an order of monetary relief to the petitioner would sub serve the ends of justice.
18. The petitioner has prayed for a protection order U/s.18 of the Act. As discussed above the petitioner has failed to prove the fact of Domestic Violence by the respondent on her. Such being the case, this court cannot relief under the Sec 18 of the Act. Apart from the self serving statements in the petition and her examination in chief the petitioner has failed to substantiate by producing cogent documents or iota evidence to prove her case. Thus, she is not entitled for the relief U/s.18 of the Act.
19. The petitioner has prayed for a direction against the respondents to provide for residence order U/s.19(1) (F) and Sec 19(8) of the Act. Such being the case, this court cannot relief under the Sec 19 of the Act. Apart from the self serving statements in the petition and her examination in chief the petitioner has failed to substantiate by producing cogent documents or iota evidence to prove her case. Thus, she is not entitled for the relief U/s.19 of the Act.
40 Crl.Misc.No.89/201320. The petitioner has sought for a direction against the 1st respondent monetary relief of Rs.16,00,000/-, compensation of Rs.5,00,00,000/- and maintenance of Rs.1,00,000/- p.m. No doubt the petitioner has not proved ingredients of the protection of women from domestic violence act, but still the 1st respondent is held respondent to pay compensation of Rs.3,00,000/- to petitioner. As 1st respondent being the husband of petitioner, he is bound to discharge his duty as husband of petitioner as per the Hindu Law. Hence, I answer Point No.1 PARTLY IN THE AFFIRMAIVE.
21. POINT No.2: In view of the materials placed before this court, pleadings, depositions and documentary evidence, this court proceeds to pass the following:
ORDER The petition filed by the petitioner U/s.12 of Protection of Women from Domestic Violence Act 2005, is allowed in part.
The protection order U/s.18 of Act is hereby rejected.
The residence order U/s.19 of Act is also rejected.
Further the respondent is directed to pay to the petitioner Rs.3 Lakhs (Rupees Three Lakhs) as compensation.
The claim of maintenance for the petitioner is hereby rejected.
The petition as against the respondent No.2 and 3 is hereby dismissed.41 Crl.Misc.No.89/2013
No order as to costs.
