The counsel for the petitioner contends that vide impugned order dated 16- 06-2025 (Annexure-P/1) the petitioner, who is working as a Middle Teacher is being sought to be transferred in the capacity of Maid Servant from Govt. Higher Secondary School, Rousharkhar, Block - Pushprajgarh District - Anuppur to Govt. Middle School, Belhai Tola, Block Pushprajgarh District Anuppur, which is impermissible.
It is the further contention of the counsel for the petitioner that the competent authority of the petitioner is Divisional Deputy Commissioner, whereas the order impugned has been passed by the Assistant Commissioner, Tribal Affairs Department, Anuppur.
The issue regarding competency is already subjudice before this Court in W.P. No.23069/2025.
List this case along with W.P. No.23069 of 2025.
Till next date of hearing, there shall be stay of the operation of the impugned order dated 16-06-2025 (Annexure-P/1) and the petitioner shall be allowed to continue at her present place of posting i.e., Govt. Higher Secondary School, Rousharkhar, Block - Pushprajgarh District - Anuppur.
