Heard learned counsel for the petitioner and the learned Additional Public Prosecutor.

This is a petition for grant of regular bail in connection with Tariyani P.S. Case No. 46 of 2018 for offences under Sections 182, 193, 195, 211, 203, 365, 368, 427, 120B/34 of the Indian Penal Code.

Allegation, in brief, is that one Kunal Kumar lodged a false case of kidnapping of his father and it is alleged that his father was riding the motorcycle belonging to the petitioner. That case was found false by the police after investigation.

Learned counsel for the petitioner submits that petitioner was not informant in that case. He has only given the motorcycle to informant's father which was recovered in abandoned condition. The petitioner has no criminal antecedent Patna High Court Cr.Misc. No.39252 of 2018(2) dt.06-07-2018 2/2 and there is no evidence showing his involvement in lodging the false case.

Having considered the aforesaid facts and circumstances, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Tariyani P.S. Case No. 46 of 2018 to the satisfaction of the Chief Judicial Magistrate, Sheohar.
