Background
1. The RTI application was filed by the Applicant on 20.7.09 with the PIO, M/o Health &Faml Welfare seeking information against 12 points with regard to the Functioning of Rajkumari Amrit Kaur Field Nursing & Teaching Centre, Chhawla, New Delhi, including the names of the Doctors, names of individuals who are monitoring the state of affairs, the aim of establishing this Teaching centre etc. The PIO vide letter dated 24.8.09 provided the information to the Applicant. Not satisfied with the PIO's reply the Applicant filed his first appeal on 2.9.09. On not receiving any reply from the Appellate Authority, the Applicant preferred an appeal before the Commission.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing for September 3, 2010.
3. Ms Aparna Sharma, Ms Harinderjeet, Ms Raminder and Ms Bhargavi C N represented the Public Authority.
4. The Applicant was not present during the hearing. Decision
5. The Respondent submitted that on 15.7.2010, on receipt of copy of the second appeal, further clarification had been provided by the CPIO. On perusal of the submissions on record and after hearing the Respondent, the Commission holds that the information against point 11 does not fall within the ambit of the RTI Act as the Appellant is not seeking information but only the opinion of the PIO. The Commission also holds that complete information has been provided against all the points except against 7, 10 against which the PIO is directed to provide further clarification. With regard to point 12, PIO is directed to try to locate the survey report in the Ministry once again, and if not available, inform the Appellant accordingly.
6. The appeal is accordingly disposed of.
