sm In the High Court at Calcutta Criminal Revisional Jurisdiction CRR No.2658 of 2017 with CRAN 3374 of 2017 Habibul Islam & Ors.

Vs. The State of West Bengal & Ors.

Mr.Angsuman Chakraborty Mr.Shsanka Sekhar Saha .. for the petitioners.

Ms.Faria Hossain .. for the State.

Heard the learned advocate appearing on behalf of the petitioners, who contended that the victim suffer from an accidental burnt and now she has realized that the matter should be compromised. Accordingly, she has also filed an application stating in her 'Notarial Certificate' that she does not have any grievance.

The learned advocate also submitted that a considerable amount as lump sum has been given to the wife. On perusal of the FIR, injury report and the statements of the victim, it appears to me, prima facie, that there is an offence committed under sections 498A/307/326 of the Indian Penal Code.

This being the situation, this court is not inclined to invoke the power conferred under section 482 of the Code of Criminal Procedure, 1973. Accordingly, the same is allowed in part in respect of the accused petitioners except the accused petitioner no.2. The trial will proceed against the accused petitioner no.2.

However, the learned trial court shall proceed the case in accordance with law.

2

Accordingly, this revisional application along with the application, being CRAN 3374 of 2017, stands disposed of.
