Banerjee) Mr. Dhananjay Nayak ...for the petitioner This application under 227 of the Constitution of India is at the instance of the preemptee in a proceeding under Sections 8 and 9 of the West Bengal Land Reforms Act praying for a direction upon the learned Civil Judge (Jr. Division) 1st Additional Court, Alipore to dispose of Pre. Misc. Case No. 10 of 2022 expeditiously.

Mr. Nayek, learned advocate appearing for the petitioner submits that the application under Order 6 Rule 17 of the Civil Procedure Code filed by the opposite party herein and the application under Order 7 Rule 11 of the Civil Procedure Code filed by the petitioner herein are pending. He further submits that August 30, 2025 is the next date fixed for hearing of the aforesaid applications.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite parties. However, the 2 learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this order, upon the opposite parties or upon the learned advocate representing the opposite parties before the learned trial judge.

In the light of the submissions made by the learned advocate appearing for the petitioner CO 997 of 2025 stands disposed of by requesting the learned Civil Judge (Jr. Division) 1 st Additional Court, Alipore to take up the hearing of the plaintiff's application under Order 6 Rule 17 of the Civil Procedure Code and the application under Order 7 Rule 11 of the Civil Procedure Code, if the same are otherwise ready for hearing and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties.

It will be open to the learned trial judge to decide which of the aforesaid applications shall be taken up first.
