1. Delay condoned.

2. We are not inclined to interfere with the impugned judgment and order passed by the High Court. The special leave petition is, accordingly, dismissed.

3. However, we clarify that the order of the High Court should not be construed as preventing the petitioner from making an appropriate application to the appropriate Court, particularly in Signature Not Verified Digitally signed by Narendra Prasad view of the observations made in paragraph 11 of the judgment of Date: 2023.10.07 10:13:00 IST Reason: this Court rendered in Criminal Trials Guidelines Regarding 1 Inadequacies and Deficiences; In Re v. State of Andhra Pradesh and Others, reported in (2021) 10 SCC 598.
