Heard learned counsel for the parties and perused the record of the case.
Learned counsel for the petitioners submits that so far as petitioner No.1-Hukam Singh is concerned, he wants to withdraw the bail application with liberty to surrender before the court concerned.
So far as petitioner No.2-Indra is concerned, she is not involved in the matter. Her name has not been mentioned in the FIR and otherwise also she is a female. Thus, she may be granted bail.
On the other hand, learned PP has opposed the bail application moved by the petitioners.
After taking into consideration rival submissions of the parties and without expressing any opinion on merits of the case, which may otherwise affect outcome of the trial, but looking to the facts of this case, I am not inclined to grant bail to the petitioner No.1-Hukam Singh. Hence, his bail application is dismissed. However, he would be at liberty to surrender before the court concerned. On surrender, if he files an application for bail then the court below may consider and decide the same expeditiously.
So far as petitioner No.2-Indra is concerned, I am inclined to grant bail to her. Therefore, the SHO/IO of the Police Station Bayana, District Bharatpur is directed that in the event of arrest of the petitioner/s Indra in FIR No. 187/2010 registered for offence under Section/s 323, 341, 325 and 308 IPC, he shall enlarge her on bail provided she furnishes a personal bond in the sum of Rs.25,000/- with one surety in the like amount to his satisfaction on the following conditions:-
(i)She shall make herself available for interrogation by Investigating Officer as and when required;
(ii)She shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any Police Officer;
(iii)She shall not leave India without previous permission of the Court.
(iv)She shall not commit same and similar offence during the period of bail.
