Petitioners in these batches of writ petitions claim to be persons working as teachers in Adarsha Vidyalayas and upgraded government secondary schools and had been appointed as per the recruitment process conducted by M/s Astrix Technologies Pvt Ltd, [ninth respondent in WP No 17846-971 of 2013], an agency of Rashtreeya Madhyamika Shiksha Abhiyan (Karnataka) [third respondent in WP No 17846-971 of 2013], pursuant to notification issued on the website of M/s Astrix Technologies Pvt Ltd, inviting applications for the post of teachers and having applied within the stipulated time.

It is the claim of the petitioners that they were all being appointed initially on contract basis for a period of one year in the year 2011 and it has been extended on several occasions for shorter durations and in the case of first petitioner in WP No 17846-971 of 2013 as per the offer of appointment made on 17-8-2011 [Annexure-H) and as 63 per the clause-4 of this offer letter, it was up to 20-4-2012 and had been extended on three more occasions vide Annexure-L. M and N in these writ petitions, up to 10-4- 2013. It is the case of the petitioners that similar orders have been made in respect of all petitioners and they have been working as teachers in either Adarsha Vidyalayas or upgraded schools. It is the further case of petitioners that such appointments were made by making applications, going through the selection procedure of written test and their merit in the qualifying examination etc., and they have all been selected merit-wise as per the respective ranking evaluated based on the total merit.

While petitioners are serving to the best of their abilities and to the satisfaction of the concerned, Rashtreeya Madhyamika Shiksha Abhiyan having caused issue of a notification dated 2-4-2012 [copy at Annexure-U to WP No 17846-971 of 2013 and the state government having now caused the publication of this notification 64 inviting applications for the very post which the petitioners are serving in and the process of this selection process as per the notification, having the effect of the petitioners' services being brought to an end on regular or persons who are recruited as per the notification at Annexure-U and the petitioners apprehend that their services will be brought to an end thereafter and without taking note of their past services, have approached this court for issue of various reliefs, as under:
IN WP NOS. 13573-608 OF 2013
a) Issue a writ or direction in the nature of Prohibition, restraining the respondent no.5-7 from filling up the posts in pursuance of the Selection List.
b) Issue a writ or direction in the nature of Certiorari, quashing the Selection List, filed at "Annexure - J & J1" in date & no. nill issued by the Respondent No.5-7 herein
c) Issue a writ or direction in the nature of Prohibition, restraining the respondents from enforcing the Karnataka Education Department Services (Department of Public Instructions) (Recruitment) (Amendment) Rules, 2002, vide "Annexure - G", for 65 appointment of candidates for the posts to be filled in Adarsha Vidyalaya (English medium) and Upgraded Upper Primary Schools with Class 9th & 10th (Kannada medium) across Karnataka Schools.
d) Issue a writ or direction in the nature of certiorari, declaring that, the process of Recruitment of 513 posts in Adarsha Schools (English medium) and 795 Teachers in 304 Schools of Upgraded Upper Primary Schools with Class 9th & 10th (Kannada medium) across Karnataka, as published in "Praja-vani" Kannada daily news-paper, as ultra-vires the powers conferred under the Karnataka Education Department Services (Department of Public Instruction) (Recruitment) (Amendment) Rules 2002.
e) Issue a writ or direction in the nature of Mandamus, directing the respondents to treat the selection of the petitioners as Regular Selection List, further treat their appointment as valid and forward their appointment to the Central Government through H R D Ministry, for approval and will approval is given, the petitioners shall not be replaced.
f) In the alternative, issue a writ or direction, in the event of holding by this Hon'ble court, that the 2002 Rules is applicable, then, direct the respondents to extend 2% yearly service weightage to the petitioners on par with that of Teachers who are 66 working on contract basis, honoraria and Part-Time.
g) Issue any other writ or direction, as this Hon'ble Court deems fit, in the facts and circumstances of the case, in the interest of justice and equity.
IN WP NOS. 14679-722 OF 2012
(i) RESTRAIN the selection authority i.e. respondents No. 5 to 9 from filling up the posts including the process of recruitment in respect of Adarsha Vidyalaya (English Medium) and Upgraded Upper Primary Schools with Class 9th and 10th (Kannada Medium) Across Karnataka Schools since the said Adarsha Vidyalaya (English Medium) and Upgraded Upper Primary Schools with Class 9th and 10th (Kannada Medium) Across Karnataka schools is the Central Government H.R.D. scheme under RASHTRIYA MADHYAMIK SHIKSHA ABHIYAN.
(ii) RESTRAIN the respondents from enforcing the Karnataka Education Department Services (Department of Public Instruction) (Recruitment) (Amendment) Rules, 2002 Annexure-L as the said Rules are very specifically silent about the category of posts called Adarsha Vidyalaya (English Medium) and Upgraded Upper Primary Schools with Class 9th and 10th (Kannada Medium) Across Karnataka schools.

(iii) DECLARE that the process of recruitment of 518 and 1836 teachers published in Prajavani News paper dated 16.4.2012, Annexure-D is totally ultra vires the powers conferred under the Karnataka Education Department Services (Department of Public Instruction) (Recruitment) (Amendment) Rules, 2002.
(iv) ISSUE a writ of mandamus directing the respondents to treat the selection of the petitioners as valid appointments under R.M.S.A. scheme and continue the services of the petitioners till the regular recruitment is made with the prior approval of the Central Government through its H.R.D. Ministry.
(v) ISSUE a writ of mandamus directing the respondents not to replace the services of the petitioners with other set of employees in view of the law laid down by the Hon'ble Supreme Court of India in the matter of PIARA SINGH reported at AIR 1992 SC PAGE 2130 PARA 25.
(vi) ISSUE a writ of mandamus directing the respondents - Central Government through its H.R.D. Ministry in consultation with the State Government to evolve criteria for recruitment to the post of teachers working Adarsha Vidyalaya (English Medium) and Upgraded Upper Primary Schools with Class 9th and 10th (Kannada Medium) Across Karnataka schools on par with that of the teachers working in Kendrya Vidyalaya School.

(vii) GRANT such other order of direction as deems fit to grant in the facts and circumstances of the case.
IN WP NOS. 43597 OF 2012 & 1347-56 OF 2013 i. RESTRAIN the selection authority i.e. respondent No.5 to 9 from filling up the posts including the process if recruitment in respect of Adarsha Vidyalaya (English Medium) and Upgraded Upper Primary Schools with class 9th and 10th (Kannada Medium and upgraded upper Primary Schools with class 9th and 10th (Kannada Medium) Across Karnataka Schools is the Central Government H.R.D. scheme under RASHTRIYA MADHYAMIK SHIKSHA ABHIYAN.
ii. RESTRAIN the respondents from enforcing the Karnataka Education Department Services (Department of Public Instruction) (Recruitment) (Amendment) Rules, 2002 Annexure - L as the said Rules are very specifically silent about the category of posts called Adarsha Vidyalaya English Medium) and upgraded Upper Primary Schools with Class 9th and 10th (Kannada Medium) Across, Karnataka Schools.
iii. DECLARE that the process of recruitment of 518 and 1836 teachers published in Prajavani News paper dated 16/04/2012, Annexure - B is totally ultra vires the powers conferred under the Karnataka 69 Education Department Services (Department of Public Instruction) (Recruitment) (Amendment) Rules, 2002. iv. ISSUE a writ of mandamus directing the respondents to treat the selection of the petitioners as valid appointments under R.M.S.A. scheme and continue the services of the petitioners till the regular recruitment is made with the prior approval of the central Government through its H.R.D. Ministry.
v. ISSUE a writ of mandamus direction the respondents not to replace the services of the petitioners with other set of employees in view of the law laid down by the Hon'ble Supreme Court of India in the matter of PIARA SINGH reported at AIR 1992 SC PAGE 2130 PARA 25.
vi. ISSUE a writ of mandamus directing the respondents - Central Government through its H.R.D. Ministry in consolation with the State Government to evolve criteria for recruitment to the post of teachers working Adarsha Vidyalaya (English Medium) and Upgraded Upper Primary Schools with Class 9th and 10th (Kannada Medium) Across Karnataka schools on per with that of the teachers working in Kendrya Vidyalaya school.
vii. GRANT such other order or direction as deems fit to grant in the facts and circumstances of the case.
70IN WP NOS. 17846-971 & 17973-77 & 17978 OF 2013
a) ISSUE a Writ of Mandamus or any other appropriate Writ, Order or direction holding that the Petitioners have been regularly recruited in pursuant to the authorization granted by Respondents No.1 to 3 to the 9th Respondent and further hold that the steps taken by the Respondents No.2 and 4 to 8 as per the notification beaing No.A1 (Prow. Sha. Shi. Ne/01/2012-13 dated 2.4.2012 marked at Annexure-U to recruit teachers to Adarsha Vidyalayas and upgraded schools in the State of Karnataka is illegal and violative of Articles, 14, 16 and 21 of the Constitution.
b) ISSUE a Writ of Certiorari or any other appropriate writ, order or direction quashing the Notification bearing No. A1 (Prow.Sha.Shi.Ne/01/2012-13 dated 2.4.2012 is marked at Annexure-U to the extent of recruitment to Adarsha Vidyalayas and upgraded schools managed by Respondents No.1 to 3 as illegal and violative of Articles 14, 16 and 21 of the Constitution.
And Without Prejudice To Prayers (a) and
(b) Above
c) ISSUE a Writ of Mandamus or any other appropriate Writ Order or Direction, directing Respondents No.1 to 8 to grant 5% of additional weightage, for each completed year of service put in by the Petitioners as teachers in pursuant to 71 Annexure B, C and D and the subsequent orders of appointment as being given to similarly situated teachers appointed in the services of the education department of the Government of Karnataka and in the Morarji Desai Residential Schools owned by the Government of Karnataka.
d) ISSUE a Mandamus or any other appropriate Writ Order or Direction, directing the 1st Respondent to hold an enquiry regarding the award of commission to the extent of more than Rs.5,488/- per teacher per month ever since 2011 to the 9th Respondent either through the CVC or through the CBI take steps to recover the said money and pay the same to the Petitioners to meet the ends of justice.
e) ISSUE a Writ of mandamus or any appropriate Writ, Order of Direction directing Respondent No.1 to 3 to take steps to recover the security deposit made by the petitioners to the tune of Rs.
12,000/- and Rs. 14,000/- from the 9th Respondent which has been paid by the individual teachers and further direct the above Respondent No.1 to 3 to refund the same to the Petitioners and other teachers to meet the ends of justice.
f) Pass such other order/orders as this Hon'ble Court deems fit to pass, including the costs of the Petition throughout to meet the ends of justice.

4. Petitioners have also sought for alternative prayers and relief.
5. Notice had been issued to the respondents. State government and its officers are represented by Sri Raghavendra G Gayatri, learned AGA, Rashtreeya Madhyamika Shiksha Abhiyan is represented by Sri P S Dinesh Kumar, Advocate, Union of India is represented by Sri S Kalyan Basavaraj, ASG.
6. Rashtreeya Madhyamika Shiksha Abhiyan is a society created under a central scheme for improving the quality of education in notified and selected backward areas in the State and particularly there being 74 educationally backward blocks have been notified and selected for starting either Adarsha Vidyalayas or upgrading the existing government schools and proposed Adarsha Vidyalayas said to be 74 in number and the number of government schools to be upgraded is 304 and the 73 Rashtreeya Madhyamika Shiksha Abhiyan being the primary agency under the scheme to monitor the implementation of the scheme through the state governments, has filed its statement of objections. Though submissions have been made on behalf of the state government and its officers, no statement of objections has been filed on their behalf.
7. As respondents are served and the writ petitions are not being formally admitted, the matters are listed for preliminary hearing in 'B' group category of cases and I have heard Sri Narasingasa P Singri, learned counsel for petitioners in WP No 13573-608 of 2013, Sri V Lakshminarayana, learned senior counsel for petitioners in WP Nos 14679-722 of 2012, M/s P B Raju and B Pradeep, learned counsel for petitioners in WP No 43597 of 2012 & 1347-56 of 2013 and Sri Narayan Bhat, learned counsel for petitioners in WP No 17846-971 & 17073-77 & 17978 of 74 2013 and learned counsel for respondents as mentioned above.

What is essentially contended on behalf of the petitioners by their learned counsel is that the process of selection when the petitioners were appointed earlier was not under the regular basis, in the sense that it is purely based on merit and on being notified and inviting applications and the selection though had been made by a private agency was at the behest of Rashtreeya Madhyamika Shiksha Abhiyan and therefore petitioners were all selected in a normal selection procedure by open competition; that there was no backdoor entry method; that just because the process of selection has been outsourced through a private agency, it does not detract from the merit of the petitioners for being selected and for continuing in the post and therefore filling up of the very posts by notifying it again is not permitted; that if at all it can be done, only after regularizing the services of the petitioners 75 and for the remaining vacancies, other selection process can be put in place.
9. Petitioners have also questioned the selection procedure and the notification stipulating the selection procedure by adopting the Karnataka Education Department Services ((Department of Public Instructions) (Recruitment) (Amendment) Rules, 2002 [for short, the 2002 Rules] by the state government for selecting candidates for filling up the posts by contending that the selection and appointment are all pursuant to a centrally sponsored scheme and therefore the state government Rules cannot be adopted as the norm or basis for selecting the posts. Submission is that selection of teachers in Adarsha Vidyalayas, which were essentially one for imparting education in English medium, should be only based on the candidates having also been graduates studied in English medium and diluting this as per the scheme is under the Rules, which is now adopted by the 76 state government for the selection procedure, even those who had studied in Kannada medium, English as a subject can also apply and compete, whereas all writ petitioners who were appointed in Adarsha Vidyalayas as per the earlier notifications have all along studied in English medium.
10. It is also complained by the learned counsel for petitioners that engaging a private agency for recruiting to the post of teachers in a state organization, in the sense, controlled by the state is illegal; that there were lot of malpractices indulged in such recruitment; that under the scheme though the salary or payment to the recruitment agency was indicated to Rs 18,000/- per teacher per month, the teachers were only paid by the agency a sum of Rs 12,000/- per month; that the recruitment agency had also demanded initial deposit of Rs 12,000/- in the first year and Rs 14,000/- in the second year, which has not been refunded also; that all such malpractices vitiate the 77 procedure of selection. It is, nevertheless, submitted by the learned counsel for petitioners that the selection being based on merit, no exception can be taken to the selection of the petitioners and for their continuation.

One another contention urged on behalf of the petitioners is that they were all persons who are selected and recruited when no rules had been framed for recruitment and therefore when the appointments have been made on a definite norm and on merit, that should not be disturbed at this point of time in the making of selection through regular recruitment process under the 2002 Rules.
12. It is also urged on behalf of the petitioners that if for any reason this court is unable to sustain the earlier appointment and cannot direct continuation of the appointment of the petitioners, as petitioners also have applied in response to the present recruitment notification, their past services should not be ignored; that there are 78 instances when such past services of candidates who had been selected by state agencies on a definite norm and merit had not been ignored, but was taken note of to give weightage to the past service, in the sense that certain percentage of marks were added depending on the length of service and for each year of service; that in the case of petitioners also, the respondents should be directed to provider such weightage for their past service as was being given earlier. It is also urged that 2002 Rules does provide for the same.
13. On the other hand, on behalf of the respondents, with reference to the statement of objections, it is submitted by Sri P S Dinesh Kumar, that it is no doubt true that the central government had formulated the scheme for improving the quality of education in backward areas and by setting up Adarsha Vidyalayas and also upgrading the existing government schools; that Rashtreeya Madhyamika Shiksha Abhiyan is created under the scheme, by the state 79 government; that the scheme of the central government is to provide funds to the state government and the state government has brought into existence Rashtreeya Madhyamika Shiksha Abhiyan society for the purpose of implementation of the scheme in the state of Karnataka; that it is so authorized by the scheme and as per this society has been brought into existence; that immediately thereafter, recruitments could not be made, it had been done on a temporary basis, as the society itself did not have the infrastructure, it had engaged the services of M/s Astrix Technologies Pvt. Ltd. as an agent for identifying possible candidates to fill in the gap; that even then, as contended by the petitioners, the agency was directed to follow norms and selection was made based on the merit of the candidates, but it had been stipulated that it was only a temporary arrangement and the agency itself had indicated this in the letter offering appointment to the petitioners and now that a regular procedure is being followed for selection and appointment, the petitioners cannot put forth a right to 80 continue in the temporary posts nor to seek for weightage etc.; that they can also participate, as they have already applied, and if the selection being on merit, it cannot be found fault with the present notification inviting applications for filling up the post on regular basis. It is submitted that the selection process is completed and it can be given effect to; that the earlier temporary appointment on contractual basis does not give a right to any person for seeking regular appointment and therefore urges for dismissal of the writ petitions.
14. In so far as the weightage is concerned, it is pointed out that the Rules are being applied uniformly to all applicants and the recruitment process is not making any distinctions and therefore no exception can be taken to the procedure followed.
15. In so far as the refund of deposit is concerned, Sri Dinesh Kumar, learned counsel appearing for Rashtreeya Madhyamika Shiksha Abhiyan, though does not dispute 81 that M/s Astrix Technologies Pvt Ltd was acting as an agent of Rashtreeya Madhyamika Shiksha Abhiyan for recruitment on temporary basis and for a limited period, Rashtreeya Madhyamika Shiksha Abhiyan had not permitted for collecting any deposit from the candidates and the same was not within the knowledge of the society and without any direction and in the circumstances, it is open to the petitioners to workout their rights and remedies against M/s Astrix Technologies Pvt Ltd in accordance with law and no liability can be fastened on the society.
16. On behalf of the state government, it is submitted by Sri Raghavendra G Gayatri, learned AGA, that no special treatment can be given to the petitioners just because they have been temporarily employed earlier; that the society which is created by the state government has been implementing the scheme and selection process on regular basis, initial appointment cannot give any right to any person, as it was only on contract basis and the petitioners 82 having accepted the same, cannot now turnaround and seek continuation of their appointment, which was for a limited period; that the reliance placed on the decision of this court for providing weightage, the same is not applicable to the case of the petitioners; that in the case of temporary employees who had been appointed in Morarji Desai schools, as there were distinctions made between one set of temporary employees and another set, while one set having given weightage, the other set was not given and therefore this court interfered, but in the present case, no such weightage is given to any person and therefore the judgment is not applicable.
17. It is not in dispute that the petitioners had been appointed for a limited period earlier, irrespective of whether they had gone through the selection based on merit or otherwise, while M/s Astrix Technologies Pvt Ltd is a private agency, it had selected the petitioners at the behest of Rashtreeya Madhyamika Shiksha Abhiyan. 83
18. Contract appointment is frowned upon by courts and the Constitution and Supreme Court has time and again pointed out that a contract employee does not get a right to seek for regularization as a matter of course. In so far as the matter of employment by the state government is concerned, the Constitutional mandate is that the state government should provide equal opportunity to all qualified candidates. It is there being any denial of opportunity and therefore open system of notification and selection based on merit is adopted. Any deviation from this norm either by the state or state controlled agencies will flaw the selection procedure. Likewise, either concession or reservation to any applicant can only be in accordance with law and not otherwise.
19. It is rather ironic that the learned counsel for petitioners vehemently urge that the state had indulged in practising illegality and at any rate rampant irregular procedure of outsourcing the selection to the post of 84 teachers under the state agency viz., Rashtreeya Madhyamika Shiksha Abhiyan through an outside private agency. If this argument is to be accepted, then the selection through an outside agency cannot have any legal sanction to be sustained, but the argument is that even the outside agency having followed merit as the basis for selection, petitioners' selection at this point of time should not be disturbed.
20. Selection to a post under the State should be made in accordance with a definite norm and if any Rules regulate the same, in accordance with these Rules. An arrangement made for a contingency and for a limited period cannot be recognized as an arrangement for good. Just because it may be the arrangement that worked successfully or satisfactorily and even if had followed the selection by merit etc. But, that does not sanctify a selection through a private agency to a public appointment to be continued or justified to be continued for all times. 85 Moreover, petitioners having been made known that the appointment was for a temporary period and will come to an end on the expiry of the term cannot claim any particular right.
21. In so far as the dispute relating to non-refund of the deposit is concerned, it is not known as to who all deposited the amount with whom etc. However, if petitioner had been made to deposit by M/s Astrix Technologies Pvt Ltd and if that was termed as a security deposit and if it is so and if it has not been refunded by M/s Astrix Technologies Pvt Ltd, whether it was within the knowledge or not, Rashtreeya Madhyamika Shiksha Abhiyan cannot wash off its hands. It is for the petitioners to make a demand on M/s Astrix Technologies Pvt Ltd to refund the deposit and to follow that course of action. In the event of their failures or M/s Astrix Technologies Pvt Ltd does not respond, then Rashtreeya Madhyamika Shiksha Abhiyan will be responsible for ensuring that the 86 deposit amounts are refunded to the petitioners and on being satisfied of the same and if the petitioners are not so refunded, it is for the Rashtreeya Madhyamika Shiksha Abhiyan to ensure that any amount that the petitioners had deposited with its agent is made good to the petitioners and to claim reimburse from its agent.
22. In so far as the argument for weightage is concerned, there is some dispute that the present Rules that have been adopted do provide for such weightage to be given even as per the Rules. Though it is disputed by Sri Raghavendra G Gayatri, learned AGA and Sri Dinesh Kumar, learned counsel for respondent-authorities, and submits that now that the recruitment rules of 2002 of the state government is being adopted for the selection procedure, it will be done in accordance with law and there cannot be any deviation from that and the rules will decide as to who becomes entitled for the weightage and as envisaged under the Rules itself and it is a matter for being factored in the selection 87 procedure and as the selection procedure is still on and it is not definite as to what the rules provide for at this point of time.
23. It is only expected that the selecting authority will abide by the Rules and there is no presumption that a public authority violates rule. In fact, the presumption is otherwise. In fact, it is for ensuring the procedure for selection is proper and fair manner and if any failure of constitutional norms and stipulations, courts interfere and invalidate the selection. Even without a demour, learned counsel for petitioners contended that the earlier selection process was not on regular selection process but it was tainted due to several irregularities and illegalities and if so the petitioners who are beneficiaries under such selection cannot claim any benefit, but the selection authority had followed all procedures of regular selection process, but it was only as a temporary measure for a limited period. Even assuming to be so, this court cannot issue any 88 directions for regularization of such appointment, as in some or other, it was not a regular permanent appointment and no such assurance had ever been given to the petitioners.
24. However, it is to be observed before parting with these cases that if the petitioners had been continued till regular appointments are made, that is not in any way to be interfered with by this court and it is for the respondents to provide for such arrangements till regular appointments are made so that there is no hiatus in the imparting of education in the schools concerned. The agency having been engaged for a limited period and with the terms of the appointment having ended, there will not be any right to the petitioners to seek for continuation or for other benefits. But, now that they have also applied for the post as per the new notification, for which 2002 Rules are being made applicable, and that being adopted in uniform in respect of all candidates and with the scheme itself having 89 provided for authorizing the state government to implement the project in the respective states and if the state governments have in implementing the project, created Rashtreeya Madhyamika Shiksha Abhiyan applying norms uniformly, no exception can be taken and the central government having not stipulated any particular norm for recruitment and it had been specifically left to the state governments to follow the procedure for recruitment, it cannot be said that adopting the state government Rules as amended in the year 2002 is an act of illegality or that it militates against the central scheme, just because earlier some method had been followed by a private agency, it does not mean that procedure should be followed for ever.
25. Therefore, at this point of time, I do not find any need or scope for issue of any writs in favour of the petitioners, except observing that Rashtreeya Madhyamika Shiksha Abhiyan is responsible for ensuring that the security deposits, if any, had been made by any of the petitioners 90 and M/s Astrix Technologies Pvt Ltd had collected the amount but has not refunded the same, then the society being the principal, it has to ensure that the amounts are refunded and if the petitioners satisfy Rashtreeya Madhyamika Shiksha Abhiyan about the same that they have made bona fide efforts.
26. It is made clear that courts do not extend any weightage or any concession or any exemption. Any concession or exemption is not a matter of right. However, when any exemption or concession or weightage is given by the statute or rules or by on administrative instructions, it may come up for examination before courts. If there is any discrimination, concession or exemption or weightage may be found fault with, but courts by themselves do not extend such benefits, as it is the prerogative of the other wings of the state. It is always open to the petitioners to appeal to the authorities and it is also for the authorities to implement such provisions, if are extended by the rules 91 themselves in a pragmatic and uniform manner and not to discriminate any one on that aspect. It is also to be borne in mind that applications had been invited from qualified persons to fill up the post of teachers in Adarsha schools and upgraded higher secondary schools and the conditions had already been notified, this court, though no doubt, has the authority and jurisdiction to pass suitable order, a direction for modification of the terms of appointment cannot be made by this court during the process of selecting candidates, as that will amount to varying the terms of employment midway even before the process of selection is completed. Such an act is per se discriminatory and cannot be sustained. When such is the legal position, the question of this court issuing directions to respondents to provide for weightage to persons like petitioners and thereby compel the respondents to commit a discriminatory act does not arise. Therefore, such a writ or direction cannot be issued at all by this court.

27. I do not find any scope for interference with the notification inviting applications for selection to the post of teachers on a regular basis. Except for the observations made above, these writ petitions are disposed of, by dismissing the same.
