Order 24/11/2022 In pursuance to the earlier order of this Court, District Education Officer, Elementary Education, Jodhpur has filed additional affidavit. He states that out of the total 81 government girls and boys schools in the district, as per the earlier reports shortcomings were pointed out in two boys schools but the same have been removed and repairs have been carried out in full.

Shri Saraswat has confined his submissions to the toilet facilities in the schools leaving aside all other issues for the time being. He submits that despite the above additional affidavit, the toilet facility in the schools is far beyond satisfaction. He has placed reliance upon certain newspapers clippings.

Even otherwise we are of the opinion that the affidavit falls short of clearly mentioning as to whether all the schools are having separate toilet for boys, girls and teachers; whether 10% (Downloaded on 30/11/2022 at 10:22:39 PM) (2 of 2) [CW-6815/2017] of the amount supposed to be utilized for maintenance of toilets is actually being used for this purpose; whether sufficient cleaning staff for the toilets is employed and carrying out the duties regularly; and whether the water in the toilet is available round the clock and as to the nature of the toilets that exist.

Accordingly, we direct Shri Pankaj Sharma, learned Additional Advocate General to file further affidavit in this regard specifying all the above aspects clearly.

The affidavit may be filed within a week.
