FACTS
Vide RTI dt 8.6.11, appellant had sought information on five points relating to action taken on a CVC letter dt 3.9.10.
2. PIO vide letter dt 1.7.11, provided a response to query no.1 and with regard to queries 2-5, observed that as the matter was under
investigation, the information was exempt u/s 8(1)(h) of the RTI Act.
3. An appeal was filed on 10.7.11.
14. AA vide order dt 5.8.11, upheld the decision of the PIO.
5. Not satisfied with the response, he filed the present appeal.
6. Submissions made by the appellant and public authority were heard. The appellant submitted that the response provided by the then PIO Shri S.S.Rawat is incorrect as at that point of time no action had been initiated on the letter received from CVC.
7. Shri Y Arun Kumar, Assistant Commissioner (Vig & Academic) is directed to provide a written submission to the Commission, within a week, after ascertaining the position from the records available. It must be clarified as to whether the response provided by the then PIO is correct or otherwise. The Commission shall take a view, once the submissions are received.

8. The Commission is in receipt of written submission dt 16.11.12 from Shri Y.Arun Kumar, Asstt Commissioner (Vig & Acad) and taken on record. On perusal of the same, we find that the investigation process was already initiated prior to the date of filing of RTI.
DECISION
9. The Commission upholds the decision of the PIO/AA. The appeal is disposed of Sd/-
