Central Bureau Of Investigation vs Dipak Kumar Lahiri on 6 February, 2018

Bench: Adarsh Kumar Goel, Uday Umesh Lalit

IN THE SUPREME COURT OF INDIA
                                    CRIMINAL APPELLATE JURISDICTION

                                    CRIMINAL APPEAL NO.233-234 OF 2018
(@ SPECIAL LEAVE PETITION (CRL.) NOS. 7807-7808 OF 2013)

     CENTRAL BUREAU OF INVESTIGATION ...APPELLANT(S)

                                                             VERSUS

DIPAK KUMAR LAHIRI & ANR. ...RESPONDENT(S)

                                                O R D E R

Leave granted.

Heard learned counsel for the appellant. In spite of service, none appears for the respondents.

It is pointed out that there were two transactions for which two separate charge-sheets were filed. The High Court has quashed both the charge-sheets on the ground that both the charge-sheets related to a single transaction.

Having regard to the facts and circumstances, we find the impugned order to be unsustainable which will stand set aside.

The appeals are, accordingly, allowed.
