As per the order no. 38 dated 20.02.2026, ninth supplementary counter affidavit has been filed on behalf of Respondent Nos.5 and 6 by one Yash Pal Meena, Chief Executive Officer (Municipal Commissioner), Patna, in which it is stated in paragraph nos. 2, 3, 6 and 7 as follows:

"2. That pursuant to the aforesaid directions issued by the Municipal Commissioner and the Chief Municipal Engineer, P.M.C., places have been identified for construction of permanent slaughter houses under five Circles of the P.M.C., and reports in this regard have been submitted, by the Executive Officer, Patliputra Circle by his letter no.516 dated 24.02.2026, by the Executive Engineer, Urban Development Division, Patna City, P.M.C. by his letter no.293 dated 26.02.2026, by the Executive Patna High Court CWJC No.8054 of 2022(39) dt.30-03-2026 2/4 Officer, New Capital Circle, P.M.C., by letter no.674 dated 24.02.2026, by the Executive Officer, Kankarbagh Circle, P.M.C. by letter no.960 dated 26.02.2026, and by letter no. 330 dated 28.02.2026 regarding the place identified in Bankipur Circle, P.M.C. Details of the place identified for construction of slaughter houses in different Circles of the of P.M.C. are mentioned hereunder in a tabular form:

3. That preparation of proposals with estimated cost for construction of Slaughter houses in the above mentioned Circles of the P.M.C. are under process. Once the proposals with the estimated cost are completed, the same will be sent for approval before the Empowered Standing Committee of the P.M.C. and finally the tender process will be initiated for inviting tenders for Patna High Court CWJC No.8054 of 2022(39) dt.30-03-2026 3/4 construction of the Slaughter houses under the aforesaid Circles."

That it is further stated that a drive was started to identify the shops of Animal Flesh, Fish or Poultry in different Circles of P.M.C. and as per the report submitted by the Executive Officers of the six Circles of the P.M.C. upto 18.03.2026, altogether 1420 shops were identified in the six Circles of the P.M.C., the details thereof are mentioned hereunder in a tabular form:

That similarly from 07.03.2026 to 18.03.2026 notices were issued to the different shops owners for obtaining license from the PMC and lists were prepared of those shops who were restrained from selling Animal Flesh, Fish or Poultry as they did not obtain license from the PMC, in this regard Circle wise details have been prepared in tabular forms."
2. After going through paragraph no. 3, since we found that no tender process has yet been initiated for construction of slaughter houses, we expect the concerned authority to expedite the tender process and apprise this Court on the next date by filing an affidavit about the progress made in Patna High Court CWJC No.8054 of 2022(39) dt.30-03-2026 4/4 that respect.
3. The affidavit shall also indicate as to whether notices have been issued to the persons, who do not have licenses to operate their shops, whether any further steps have been taken by such persons for obtaining the licenses and, if not, whether any action has been taken by the authority against such persons in accordance with law.
4. List this matter on 27.04.2026.
