Information sought:
The Complainant filed an online RTI application dated 26.11.2020 seeking the following information:
1) Kindly provide me the Following Analytics Report based on E-Way i)EWBs cancelled for distance of 100 KMs after 2 hours of generation.1
ii) EWBs canceled for distance of 200 Kids after 4 hours of generation.
iii)EWBs cancelled during the last hour of cancellation time
iv)ESVBs with same PIN code as source and destination but distance Is more than 100 KMs
v) Interstate EWBs Generated by Composition Tax Payers.
2) Kindly provide me the Following Analytics Report based on tax-payers:- A) Tax Payers with abnormal growth in turnover in EWBs(more than 25%) B) Taxpayers with more Outward Supplies far greater than inward supplies. C) Taxpayers with more Inward Supplies far greater than inward supplies. D) Newly registered tax payers with high Turnover in EWBs. E) Taxpayers with Cancellation of EWBs.
F)Taxpayers with Extensions of EWBs.
G) Taxpayers with EWBs of non-sale Outward supply I) Taxpayers with EWBs Part-A Generation
3) Kindly provide me the following Analytics Report based on HSN
a) HSN with cancellation
b) HSN wise cancellation (for coal/coke and Iron/Steel) I want the above information in regard to taxpayers registered in the states of Bihar, West Bengal, Jharkhand and Odisha for the period (months) May 2020 to October/November 2020 (whichever is the latest available on the date of providing the Information). I preferably want Top 2000 records for each slate for each month for each sub-head mentioned(or whichever is the highest record available amongst 2000/1000/500)".
The CPIO transferred the RTI application on 14.12.2020 to the CPIO, Goods and Services Tax Network Worldmark 1, East Wing, 4th Floor Aerocity, New Delhi.
Being dissatisfied, the complainant filed a complaint to the commission.
Relevant Facts emerging during Hearing:
The following were present:-
Complainant: Not present. (Notice of hearing received back undelivered with the remarks "Insufficient Address". Later, attempts made to reach out the Appellant on her mobile number went in vain as there was no facility of incoming calls, yet the notice of hearing was sent via email) 2 Respondent: Rajeev Tripathi, Vice President Legal & CPIO present through intra- video conference.
The CPIO submitted that the Complaint is not maintainable against his office as the reply to the RTI Application was provided on 11.01.2021 after it was received on 18.12.2020, which is well within the prescribed time line of the RTI Act.
Decision The Commission based on a perusal of the facts on record finds no scope of action in the matter and upholds the submissions of the CPIO.
The Complaint is disposed of accordingly.
