Section 86 in The Maharashtra Irrigation Act, 1976
86. Abetment of inferior holder’s rent on interruption of water supply; and enhancement of such rent on restoration of supply.
(1)Every inferior holder of any land in respect of which such compensation has been paid shall, if he receives no part of the said compensation, be entitled to an abatement of the rent previously payable by him to the superior holder thereof in proportion to the reduced value of the holding.(2)But if water supply which increases the value of the holding is afterwards restored to the said land otherwise than at the cost of the inferior holder, the superior holder shall be entitled to enhance the rent in proportion to such increased value:Provided that the enhanced rent shall not in any case exceed the rent payable by the inferior holder before the abetment, unless the superior holder shall, independently of the provisions of this section, be entitled so to enhance the previous rent.
