(c)where from facts elicited in a criminal case brought against him, in which he has not been convicted, or in a civil suit instituted against him, it is apparent that his retention in the public service is prima facie no longer desirable. These facts may be used as the basis of an order calling on him to show cause why he should not be punished by dismissal or otherwise. In such case the office concerned should have an opportunity of submitting his defence and he should not be precluded from tendering such further evidence in support of his case, as he may see fit to produce.
