ORAL ORDER
3 02-09-2019Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in Trial No. 3820 of 2018 arising out of Jogapatti (Nawalpur) P.S. Case No. 98 of 1997, instituted for the offence under Section(s) 147, 148, 149, 323, 324, 307, 302, 212 and 364-A of Indian Penal Code.
Counsel for the petitioner submits that initially in the First Information Report, petitioner is not named. Subsequently, after 32 days of the occurrence complaint was filed which was sent to Police Station under Section 156(3) Cr. P.C. in which the name of petitioner has been mentioned. The police after investigation submitted final form in the case, but learned Magistrate after differing with the final form, took cognizance against the petitioner and other accused persons by Patna High Court CR. MISC. No.41903 of 2019(3) dt.02-09-2019 2/2 order dated 16.01.2017. He further submits that other co- accused have already been granted bail by coordinate Benches of this court vide orders dated 14.11.2014, 6.6.2018 and 20.11.2018 passed in Cr. Misc. 18168 of 2013, 33520 of 2018 and 66384 of 2018 respectively.
Petitioner is in custody since 9.3.2019 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Manoj Kumar, learned Judicial Magistrate, 1st Class, Bettiah, West Champaran, in connection with Trial No. 3820 of 2018 arising out of Jogapatti (Nawalpur) P.S. Case No. 98 of 1997, subject to the condition that both the bailors will be close relatives of the petitioner.
