C.M.Appl.No.1 of 2022:

Petition to condone the delay of 44 days in filing the petition.
Petitioner filed supporting affidavit through the power of attorney holder, wife contending that her husband was away in Gulf and due to the pandemic, she could not raise funds for meeting the expenses and that actually caused the delay of 44 days in filing the appeal.
Learned counsel for the respondent objects the petition. Having regard to the averments in the affidavit and facts and circumstances and especially due to the fact that the delay caused is only 44 days, the delay condoned. Petition allowed.

There will be a direction to keep the revenue recovery proceedings in abeyance.
