For Petitioner(s) : Mr. Shelendra Kumar Chaudhary For Respondent(s) : None present HON'BLE MR. JUSTICE PANKAJ BHANDARI Judgment / Order 08/05/2019

1. Petitioner has moved this Criminal Misc. Petition for challenging the order dated 13.08.2018, passed by Family Court, Bharatpur, whereby interim maintenance application filed by the petitioner was rejected.

2. It is contended by counsel for the petitioner that petitioner was harassed by the respondent, as a result of which she could not continue with the job. It is contended that petitioner is entitled to interim maintenance, as respondent is working as Compounder.

3. I have considered the contentions and have perused the impugned order.

4. From perusal of the impugned order, it is revealed that petitioner herself was employed, as is apparent from the pay slip (Downloaded on 28/06/2019 at 11:53:48 PM) (2 of 2) [CRLMP-5969/2018] produced before the Court below. She submitted resignation on 03.08.2018, when the matter was listed for orders.

5. In view of the fact that petitioner had remained employed at the time when she moved application for interim maintenance, trial Court has not committed any error and illegality in rejecting the application. No ground is made out for entertaining the Criminal Misc. Petition.

6. The Criminal Misc. Petition is, accordingly, dismissed.
