Section 3 in The Orissa Minerals (Prevention of Theft, Smuggling and other Unlawful Activities) Rules, 1990

3. Applications for grant of licence.

- [(1) Any person who wishes to possess, store, sell, trade in or otherwise deal with any mineral shall make an application to the competent authority as required under Sub-section (1) of Section 6 for a licence for [for any or group of minerals] [Substituted vide Notification S.R.O. No. 520/15.7.1991, vide Orissa Gazette Extraordinary No. 891/31.7.1991.] in Form 'A'. The application shall be submitted in duplicate].
(2)[ Every applicant while applying the licence under Sub-rule (1) shall in his application accompany the followingIn Case of Precious and Semi-Precious Stone
(i)
(a)A Demand draft of Rs.99,500 (Rupees ninety-thousand five hundred) only to be deposited towards licence fee payable at Government Treasury Branch of State Bank of India, Bhubaneswar
A Treasury chalan of Rs.500 (Rupees five hundred) only shall be deposited in Government Treasury towards processing fee (non-refundable) under the head of Account-"0853-Non-Ferrous Mining and Metallurgical Industries-102-Mineral Concession Fees and Royalties".In Case of the Minerals
(b)A Demand Draft of Rs.4,500 (Rupees four thousand five hundred) only to be deposited towards licence fee payable at Government Treasury Branch of State Bank of India, located at or nearest to the Headquarters of the Competent Authority.
The processing fee (non-refundable) of Rs.500 (Rupees five hundred) only shall be deposited in the Government Treasury under the head of Account "0853-Non-Ferrous Mining and Metallurgical Industries-102-Mineral Concession Fees and Royalties".
(ii)
(a)In case of refusal or rejection of the application, the Demand Draft deposited towards licence fee shall be returned to the applicant,
(b)in case of grant of licence, the demand Drafts deposited towards licence fee shall be deposited with the Government Treasury under the specific head of Account.]
(3)On receipt of the application for licence the competent authority shall acknowledge the receipt in Form 'B'. The acknowledgement shall be sent to the applicant by registered post.
