Counsel for the State has placed on record written statement in which it has been averred that the petitioner has got 82 marks against the category of Dependent Ex-servicemen (DESM) for BC-B category. The cut off is 66 marks and the post is stated to have been consumed by ex- serviceman and, therefore, DESM candidates could not be considered against the said category. It has been further averred that there are 29 DESM BC-B category candidates who have scored more than 148 marks and, therefore, the petitioner has not been considered.
Resultantly, no relief can be granted to the petitioner and the writ petition is disposed of in view of the above.
