                                     JUDGMENT

1. This is a petition under section 372 of the Indian Succession Act 1925 (hereafter referred to as "the Act") filed by the petitioners Ms. Ahanan Sethi and Master Aryaman Sethi for grant of succession certificate in respect of debts and securities of their deceased father Late Atul Sethi, who left for his heavenly abode on 14.03.2015. The State as well as the other legal heirs of Late Atul Sethi have been impleaded as respondents.

2. Petitioners seek succession certificate in respect of following debts and securities of their deceased father:­

(i) (a) Amount lying account bearing 5253951224 with Citi Bank, Nehru Place Branch, New Delhi.

(b) Amount lying in account bearing No. 00271930016628 with HDFC Bank, Masjid Moth, New Delhi.

(c) Amount lying in account bearing No. 094030186006 with HSBC, Greater Kailash­I, New Delhi.

(d) Amount lying in account bearing No. SB/1/2614 with Corporation Bank, Greater Kailash­II, New Delhi.

(e) Amount lying in PPF account bearing No. 015600PPF00000000525 with Punjab National Bank, Nehru Place, New Delhi.

Notice of the petition was published in the daily newspaper 'The Statesman' dated 12.05.2015 to invite objections from the public at large for the grant of succession certificate in respect of debts and securities of SS No.36/2015 Ahana Sethi & Anr. Vs. State & Ors. Page 11/15 the deceased. None, however, appeared from the public at large to raise any objection to it.

4. Sh. Gaurav Jain, Vice President, HSBC, Greater Kailash­I has been examined as PW1. He produced the statement of dmat account, statement of saving account and mutual funds investment account of deceased Late Atul Sethi. As per statement of saving account bearing account no.

094030186006, the available balance is Rs. 76,45,805.39. He proved the same as Ex.PW1/B. As per statement of mutual funds, the payable amount is Rs. 7,97,827.49. Copy of statement of mutual fund is Ex.PW1/C. Statement of dmat account is Ex.PW1/A.

5. Sh. Siddhartha Kitchlu, Service Manager, Citi Bank, South Extension Branch, New Delhi has been examined as PW2. He produced the statement of saving bank account of deceased Late Atul Sethi bearing account No. 5253951224. As per statement of account, the available balance in account is Rs. 44,955.83. Copy of statement of account is Ex.PW2/A. He has also produced statement of mutual fund bearing account no. 3253951256, as per which the payable amount is Rs.

20,84,500.03. Copy of statement of mutual fund is Ex.PW2/B.

6. Sh. B. Channakeshavamurthy, Chief Manager, Corporation Bank, Greater Kailash­II, New Delhi has been examined as PW3. He produced statement of account of deceased Late Atul Sethi bearing account no.

SB/1/2614. As per statement of account, the available balance in the account is Rs. 1,43,150.05. Copy of statement of account is Ex.PW3/A.

7. Sh. Harmeet Singh Bawa, Relationship Manager, HDFC Bank, Greater Kailash­II, Masjid Moth, New Delhi has been examined as PW4.

He produced the statement of account of deceased Late Atul Sethi bearing account No. 00271930016628. As per statement of account, the available balance in the account is Rs. 7,93,497.40. Copy of statement of account is Ex.PW4/A.

8. Sh. Ankit Chaturvedi, SWOA, Punjab National Bank, Nehru Place Branch, New Delhi has been examined PW5. He produced the statement of PPF account of deceased Late Atul Sethi bearing account no.

015600PPF00000000525 with Kalkaji Branch. As per statement of account, the available balance is Rs. 35,63,740/­. Copy of statement of PPF account is Ex.PW5/A.

9. Respondent no. 2 Smt. Uma Sethi has been examined as RW1. She deposed that deceased Late Atul Sethi was her son. She further deposed that she has no objection if the succession certificate in respect of debts and securities of deceased son is issued in favour of petitioner no. 1 and

2. She placed on record copy of her aadhar card as Ex.RW1/A.

10. Petitioner no. 1 Ms. Ahana Sethi has been examined as PW1. She deposed that her father Sh. Atul Sethi passed away on 14.03.2015. The death certificate of her deceased father is Ex.PW6/A. The deceased did SS No.36/2015 Ahana Sethi & Anr. Vs. State & Ors. Page 13/15 not leave any Will behind him. She deposed that her deceased father is survived by her, her brother Master Aryaman Sethi (petitioner no. 2) and her grandmother Smt. Uma Sethi (respondent no. 2). She further deposed that her grandmother has no objection if the succession certificate is issued in her favour as well as in favour of her brother i.e petitioner no. 2.

The total value of debts and securities for which succession certificate is sought for is Rs. 47,94,34,346.93. She placed on record copy of her aadhar card is Ex.PW6/B. The consolidated statement of demat account and mutual fund folio is Ex.PW6/C.

11. I have heard the arguments advanced by the Ld. counsel and gone through the records.

12. From the oral testimony and documents on record and the death certificates Ex.PW6/A, it is clear that Late Atul Sethi passed away on 14.03.2015. As per the testimony of the petitioner no. 1, she, her brother and her grandmother are the only surviving legal heirs of deceased.

Respondent no. 2 has given her no objection to the grant of succession certificate in respect of debts and securities of deceased in favour of petitioner no. 1 and 2.. The total value of the debts and securities, for which succession certificate is sought for, is Rs. 47,94,34,347/­.

13. None has appeared on behalf of the public at large to contest the aforesaid claim of the petitioner. There is also no impediment under SS No.36/2015 Ahana Sethi & Anr. Vs. State & Ors. Page 14/15 section 370 of the Act to the grant of succession certificate. Therefore, I deem it fit to allow this petition. This petition is hereby allowed.

14. I, therefore, hold both the petitioners namely Ms. Ahana Sethi and Master Aryaman Sethi entitled to grant of succession certificate under section 373 of the Act in respect of the aforesaid debts and securities of their deceased father.

15. Accordingly, succession certificate be issued to both petitioners namely Ms. Ahana Sethi and Master Aryaman Sethi (being minor through his mother Smt. Sheuli Sethi till he attains majority) on filing of Court fees of Rs. 59,92,929/­ each in terms of Article 12, Schedule 1 of Court fees Act, 1870 and an indemnity bond in the sum of Rs. 23,97,17,174/­ each with one surety in the like amount. File be consigned to Record Room.
