1. By way of the present application, the applicant seeks grant of anticipatory bail in case arising out of FIR bearing No.49/2025, registered at Police Station Cyber, North West for the commission of offences punishable under Sections 318(4) of the of the Bharatiya Nyaya Sanhita, 2023 (hereafter 'BNS').

Briefly stated facts of the present case are that as per the FIR, on 30.07.2025 the complainant alleges that her husband was contacted by an unknown person through an online chat on the Kucoin cryptocurrency exchange and was induced to invest in cryptocurrency trading on the promise of assured returns. Initially, an amount of ₹1,000 was invested, after which the complainant was shown purported profits and persuaded to make further deposits. It is alleged that, pursuant to such inducement, the complainant transferred a total sum of ₹3,38,000/- through seven separate This is a digitally signed order.

Thereafter, the persons with whom she was interacting allegedly became unresponsive, and no returns or refunds were received. Realizing that she had been cheated, the complainant lodged an online complaint.

3. The learned counsel appearing for the applicant/accused states that the parties have arrived at a settlement before the Delhi Mediation Centre, Rohini District Courts, Delhi. It is further stated that the co-accused in this case has already been enlarged on bail. Further, it is argued that the applicant/accused has clean antecedents and there is no apprehension of his tampering with evidence. The learned counsel also states that the applicant/accused undertakes to join the investigation as and when required. Therefore, it is prayed that the applicant/accused be granted anticipatory bail.

4. The learned APP for the State argues that the applicant/accused was an active participant in the alleged cyber fraud and played a pivotal role in converting the cheated amount into cryptocurrency. It is further contended that WhatsApp chats establish the nexus between the applicant/accused and the co-accused persons, and that the call detail records also reflect connectivity between them. On these grounds, it is urged that the applicant/accused does not deserve the relief of anticipatory bail.

5. This Court has heard arguments addressed on behalf of both the sides and has perused the material available on record.

6. This Court notes that the dispute between the complainant and the applicant/accused has been amicably resolved. A Settlement Deed dated 17.12.2025 has been placed on record, suggesting that the parties have arrived at a full and final settlement. 7. It is to be noted that the co-accused has already been granted regular bail vide order dated 24.11.2025 passed by the learned Trial Court.

Keeping in view all the facts and circumstances mentioned hereinabove and that the applicant/accused undertaking to join investigation as and when required by the concerned Investigating Officer, this Court is inclined to grant anticipatory bail to the applicant. It is ordered that in event of arrest, the applicant shall be released on his furnishing personal bond in the sum of Rs.10,000/- with one surety of the like amount to the satisfaction of the SHO/I.O concerned on the following terms and conditions:

i) The applicant shall join the investigation, on 09.02.2026 at 4:00 P.M, before the concerned IO/SHO.
ii). The applicant shall join the investigation, as and when called by the concerned IO/SHO and shall remain available on mobile numbers; shared by him with the Police.
ii) The applicant shall not leave NCT of Delhi without prior permission of the concerned IO/SHO and shall also surrender his passport with the Police.
iii) The applicant shall not directly or indirectly make an attempt to influence the witnesses or tamper with the evidence in any manner.
iv) In case of change of residential address/contact details, the applicant shall promptly inform the same to the concerned I.O/SHO.

9. The bail application stands disposed of.

10. It is, however, clarified that nothing expressed hereinabove shall tantamount to an expression of opinion on merits of the case.
