This is a petition filed under Section 439 of the Code of Criminal Procedure seeking regular bail in a case registered against the petitioner vide FIR No. 135 dated 20.08.2011 under section 382 IPC at Police Station Division No. 4, Jalandhar.

Learned counsel for the petitioner submits that petitioner is in custody since 28.12.2011. Investigation qua him has been completed. Trial will take long time to conclude thus petitioner is entitled to be enlarged on bail.

Learned State counsel has opposed the prayer on the ground that allegations against the petitioner are serious.

Heard.

Keeping in view the aforesaid contentions, period of incarceration of the petitioner and the fact that trial may still take Crl. Misc. No. M-9210 of 2012 2 some time to conclude, I am of the considered view that no useful purpose would be served by detaining him any longer. Accordingly, the petition is allowed and petitioner is directed to be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Jalandhar.
