Facts arising from the Complaint:

Prof. Tripti Narayan Sinha had filed a RTI application with the Public Information Officer, Department of Human Resource Development (Higher education) Govt. of Bihar, Patna on 19/02/2008 asking for certain information. The PIO replied on 04/032008, aggrieved by which the complainant approaches the Bihar State Commission and on receiving no response from the State Commission the complaint filed the complaint in central Information Commission.

The Commissions is of the view that, under RTI Act 2005 it has no jurisdiction over the matter. Moreover it is evident from complaint that the matter is pending before the State Commission of Bihar.

Decision:

Complaint is dismissed Notice of this decision be given free of cost to the parties.
