Facts:-
The appellant, through his RTI application dated 15/05/2009, sought information regarding:-
(1) Duty-slips of official car used by Director(Finance);
& (2) Residential address of the said officer on the basis of which HRA is being paid to him and the total amount disbursed to the officer in respect of HRA for the period 01/06/2007 to 30/04/2009.(3)
2. In response, CPIO, vide his order dated 22/06/2009, provided copy of the log-sheets for car used by GM, Finance. In respect of Q(2), he informed that as per existing rules, HRA is paid to an officer on the basis of his city of posting and not on the basis of his residential address. Answer to question 3 was provided.
3. Not being satisfied, the appellant appealed to the FAA vide letter dated 02/07/2009, who, vide his order dated 22/07/2009, upheld the order of the CPIO.
4. The appellant has now come in appeal before the Commission.
5. The matter was heard today. The CPIO representing the respondents stated that the office only maintained the log-sheets in respect of transport being used by their officers and there was no record of any duty slips. He also submitted before the Commission a copy of the HRA Rules applicable to the BSNL officials which clearly states that HRA is admissible with reference to the place of duty irrespective of place of residence.
DECISION
6. The Commission accepts the averments made by the respondent and all information sought has been provided.
7. The matter is, accordingly, closed.
