Prima facie, it appears that the petitioner has purchased the land in question for agriculture purpose after obtaining necessary permission as required under section 63 of the Tenancy Act and there is no iota of evidence on record suggesting that the petitioner is using the land for any industrial purpose and therefore, present petition deserves consideration.
Rule returnable on 29.7.2016. Meanwhile, relief in terms of para 6(B) is granted. The respondents are directed to file affidavit-in-reply within three weeks from today. The petitioner shall file rejoinder affidavit, if any, within a week thereafter.
