2. The present Transfer Civil Miscellaneous Petition has been filed by the petitioner/wife seeking withdrawal of HMOP No.148 of 2025 pending on the file of the Family Court, Trichirapalli and to transfer the same to Family Court, Dharmapuri.
3. The petitioner is the wife. The marriage between the petitioner/wife and the respondent/husband is stated to have been solemnized on 21.02.2024. The respondent has instituted H.M.O.P.No.148 of 2025 for divorce on the file of the Family Court, Tiruchirapalli and the petitioner has filed H.M.O.P.No.175 of 2025 for restitution of conjugal rights on the file of the Family Court, Dharmapuri.

The petitioner submits that she is residing at Dharmapuri, there are no children, and that she would be put to serious hardship if she is compelled to travel to Tiruchirapalli for every hearing; whereas her restitution petition is already 2/5 https://www.mhc.tn.gov.in/judis ( Uploaded on: 10/02/2026 06:07:04 pm ) Tr.C.M.P.No.1024 of 2025 pending at Dharmapuri.

In matrimonial matters, the convenience of the wife ordinarily deserves due weight, particularly when she is residing away from the place where the proceeding is pending and when parallel proceedings between the same parties are pending in another Court. On facts, the petitioner is residing at Dharmapuri; the restitution petition is pending there; there are no children; and transfer would avoid multiplicity and facilitate an expeditious, effective adjudication.
6. The respondent has no objection for allowing the transfer petition. In view of the above, this Transfer C.M.P. is liable to be allowed.
7.Accordingly, Tr.C.M.P. No.1024 of 2025 is allowed. H.M.O.P. No.148 of 2025 on the file of the Family Court, Tiruchirapalli, is withdrawn and transferred to the file of the Family Court, Dharmapuri. The Family Court, Tiruchirapalli, shall transmit the entire records to the Family Court, Dharmapuri, within three (3) weeks from the date of receipt of this order and the Family Court, Dharmapuri shall dispose of the matter in accordance with law, as expeditiously as possible, uninfluenced by any observations made in this order. Connected C.M.P.Nos.23006 & 23009 of 2025 are closed.
