Date : 06.05.2019 None appears on call for the petitioner. Mr. S.K. Chakraborty, learned standing counsel for the BTC is present and submits that instruction has not been received. Mr. B. Gogoi, learned counsel for the respondent No. 2, Mr. R.K. Talukdar, learned counsel for the respondent No.3 and Mr. G. Bordoloi, learned counsel for the respondent No.1 are present.

The case projected in the present writ petition is that the BTC authorities are not releasing the salary of the petitioners on time. It is claimed in the present writ petition is that the petitioners No. 1 and 2 are yet to receive their arrear salary for the months of June, 2007 Page No.# 2/2 to September, 2007, January, 2008 to February, 2008, November, 2008 to December, 2008, January, 2009 to February, 2009, March, 2009 to January, 2010, February, 2010, March, 2010 to February, 2012, February, 2013, March, 2013 to February, 2014. April, 2014 to November, 2014, December, 2014 to February, 2015 which amounts to Rs.1,18,000/- each.

On the prayer made by the learned standing counsel for the BTC, 3(three) weeks further time is granted to the BTC authorities i.e. respondents No. 4 to 6 to positively file their response and to ensure within which period they intend to disburse the salary of the petitioners No. 1 and 2.

It is made clear that if affidavit-in-opposition is not filed within the 3(three) weeks period as allowed, this Court to pass appropriate orders on the next date fixed to call for the personal appearance of the Principal Secretary of BTC, Director of Handloom and Textile, Kokrajhar and the Asstt. Director of Handloom and Textile, Udalguri, BTC.

A copy of the order may be provided to the learned standing counsel for the BTC for timely compliance.
