                                     ORDER

1. This is the Suo Motu case taken up by this Tribunal on the basis of the report published in Dinamalar Daily dated 09.04.2021 on the news that the biomedical waste from the State of Kerala being dumped in the State of Tamil Nadu by lorries. One more news item with caption "Dumping of garbage foiled near Anamalai, trucks seized"

was published in The Hindu daily dated 09.04.2021.

2. While this matter is being heard and several reports and representations are received, there is yet another unfortunate news reported in Dinamalar Tamil Daily dated 07.12.2022 which has enlisted the number of occasions on which the waste of all kinds viz., Municipal waste, Fish waste, Biomedical waste, etc. are being dumped near Pollachi, Nilgiris, Anaimalai and Namakkal. It is more in the region of Pollachi Taluk.

3. Unless a serious step is taken by the Government in this regard, such kind of dumping from outside the states cannot be stopped. In this regard, already the Chief Secretary to Government both the States of Tamil Nadu and Kerala were made as a party to this proceeding.

4. The District Collector of bordering districts viz., Nilgiris, Tiruppur, Dindigul, Theni, Virudhunagar, Tenkasi, Tirunelveli and Kanniyakumari in the State of Tamil Nadu and Thiruvananthapuram, Kollam, Pathanamthitta, Idukki, Palakkad, Malappuram and Wayanad in the State of Kerala also may be Suo Motu impleaded.

5. So, the above said District Collectors are impleaded Suo Motu as respondents Nos.20 to 34 respectively and let the Government Pleaders representing the respective District Collectors apprise them of the issue and obtain individual reports from each of them. The learned Government Pleader of both the states are also directed to furnish the papers to the respective District Collectors and get appropriate instructions in this regard and file an individual report of each of them.

6. Post the matter on 20.01.2023.
