Heard the counsels for the parties.

The petitioner seeks bail in connection with Jandaha P.S. Case No. 81 of 2017 dated 24.05.2017 instituted for the offences 363, 366(A)/34 of the Indian Penal Code.

The daughter of the informant viz. Tabbasum, who is student of matriculation was allegedly kidnapped by the petitioner and his brother Mithilesh Kumar Sah.

It has been submitted on behalf of the petitioner that the so called victim returned home of her own and in her 164 Cr.P.C statement, she has stated that after a fight with her mother, she had gone to her grandmother's (Nani) house. Thus, there is no substance in the allegation levelled in the F.I.R against the petitioner.

The petitioner is in custody since 18.08.2017. Regard being had to the aforesaid facts, this Court is inclined to grant bail to the petitioner.

The petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, XI, Vaishali at Hajipur in connection with Jandaha P.S. Case No. 81 of 2017.
