Section 4(1) in Mental Healthcare (Rights of Persons with Mental Illness) Rules, 2018
(1)The Central Government or the State Government, as the case may be, shall establish such number of hospital and community based rehabilitation establishments, as it deems fit, for providing rehabilitation services required by persons with mental illness, having regard to the following, namely:--(a)the expected or actual workload of the facility to be established;(b)the number of mental health establishments existing in that State;(c)the number of persons with mental illness in that State;(d)the geographical and climatic conditions of the place where such facility is to be established.
