This criminal misc. petition has been filed under section 482 Cr.P.C. against the order dated 16.3.2012 of Metropolitan Magistrate No.11 Jaipur refusing to attest the compromise for the offence under sections 380 and 454 IPC.

Without going into the merits of the case Mr. Atish Jain, learned counsel for the petitioner placed reliance on the case of Shiji alias Pappu and ors. vs. Radhika and anr. (2012) Cr.L.J. 840 of the Apex Court. Mr. Atish Jain states that in view of the aforesaid judgment of the Apex Court the matter should be compounded on the basis of the compromise.

In view of the above I do not think it proper to pass any order at this stage directing compounding of offence on the basis of compromise, when the challan has been filed for the offence under sections 380 and 454 IPC against the accused petitioner. But in the interest of justice I direct the trial court to conclude the trial within a period of six months. If the accused petitioner moves an application for exemption of attendance, then the same should be allowed by the trial court except for those days, when her presence is necessary.

This criminal misc. petition is disposed of. The stay application also stands disposed of.
