ORDER
1. The Appellant filed an RTI application dated 28.03.2023 seeking information on the following points:
"सू चना अिधकार अिधिनयम 2005 के अ गत मीरा िसं ह प ी रामसुख िसंह ाम पूरे वहो रया पो. िवहारगंज ारा गाटा सं. 128 ( थत ा. पूरे वहो रया) पर िलये गये लोन के संबंध म सूचना उपल कराने के संदभ म
(i) उपरो मीरा िसंह प ी रामसुख िसंह ाम. पूरे वहो रया को खतौनी खसरा गा. 128 1429-1434 फ. पर मु. 101000/- एक लाख एक हजार लोन िकतने े फल पर िदया गया है | लोन ीकृित ापन की मािणत छाया ित|
(ii) तहसील सदर तापगढ़ ारा िदए गए 61 (ख) की मािणत छाया ित। Page 1 of 3
(iii) खसरे की मािणत छाया ित ।"
2. The CPIO replied vide letter dated 17.04.2023 and the same is reproduced as under :-
"आप ारा अ ाहक के खाते से स त सूचना दान करने हेतु आ ह िकया गया है पर ु इस स म अवगत हों िक स त सूचना बक के िवशेषािधकृत, आं त रक, वग कृत एवं गोपनीय द ावेजों की ेणी म आते है। बक का यह ाथिमक दािय है िक वह अपने ाहकों के खातों की गोपनीयता बनाये रखे | अतः सूचना का अिधकार अिधिनयम, 2005 की धारा - 8(1) - d व e के ावधानों के अंतगत संरि त ह।"
3. Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 01.05.2023. The FAA vide order dated 12.05.2023 observed as under:
"समी ोपरा , मेरे िवचार म के ीय जन सूचना अिधकारी, बड़ौदा यू.पी. बक, े ीय कायालय, बरे ली ने आपके ारा वांिछत सूचना के म म समुिचत सूचना दान की है (स ंिधत के ीय जन सूचना अिधकारी ारा ुिटवश उ अिधिनयम की धारा 8 (1) (j) के बजाय 8 (1)
(d) का उ ेख िकया गया है )।
अतएव मै आपके थम अपील िदनांक 01.05.2023 को अंितम प से िन ा रत करता ँ ।"
4. Aggrieved with the FAA's order, the Appellant approached the Commission with the instant Second Appeal dated 11.08.2023.
5. The Appellant remained absent during the hearing and on behalf of the Respondent, R L Bunkar, RM & CPIO attended the hearing through video conference.
6. The Respondent reiterated the denial of the information under Section 8(1)(j) of the RTI Act.
7. The Commission after adverting to the facts and circumstances of the case, and perusal of records, observes that the denial of the information by the CPIO is as per the Page 2 of 3 provisions of the RTI Act since the Appellant has sought for loan and property details of a third party. In view of this and in the absence of the Appellant to plead his case, no action is warranted in the matter.
8. The Appeal is disposed of accordingly.
Copy of the decision be provided free of cost to the parties.
