Heard Sri Radha Kant Ojha, learned senior counsel assisted by Sri Shivendu Ojha, learned counsel for the petitioner and Shri Ajit Kumar Singh, learned Senior Counsel and Additional Advocate General assisted by Sri Amit Manohar Sahai, learned Additional Chief Standing Counsel.
Brief facts of the case are that State Government has decided to fill up 68500 vacancies of Assistant Teachers in Primary Schools run by U.P. Basic Shiksha Parishad, Allahabad and for that purpose vide letter dated 9.1.2018, State Government has directed Secretary Examination Regulatory Authority, U.P. Allahabad (hereinafter referred to as "Secretary") to conduct the Assistant Teachers Recruitment Examination, 2018 (hereinafter referred to as 'Examination 2018). Pursuant to that, online applications were invited to fill up 68500 posts of Assistant Teachers through advertisement dated 8.5.2018. Petitioner being fully qualified, applied to appear in Examination 2018 by depositing requisite fee. The said Examination 2018 was held on 27.5.2018 in which petitioner had appeared. The examination consisted of one paper of 150 marks having question booklet series 'A', 'B', 'C' & 'D' and the duration of examination was 3 hours. The answer key, thereafter, was published on 05.06.2018. Objections, against proposed answers, were entertained till 09.06.2018, and the report of the expert committee was to submit its recommendation on 15.06.2018. Modified/corrected model answer key was, then, to be published on 18.06.2018 and the result was to be declared on 30.07.2018. It is not in dispute that result, ultimately, was declared on 13.08.2018 and model answer key was published. Petitioner and many others candidates are not satisfied with the result, therefore, as provided under the Rules of Examination, 2018, they have obtained their scanned copy of their answer sheet of concerned booklet series.
After comparing the scanned answer sheet with model answer key, petitioner and many other candidates are not satisfied with the evaluation, therefore, several petitions have been filed. Leading Writ Petition No. 18235 of 2018 (Aniruddh Narayan Shukla and 118 others Vs. State of U.P. and 3 others) was ultimately decided by this Court vide order dated 30.10.2018 with certain guidelines for revaluation of answer books of the petitioner as well as other candidates within fixed time frame. Opportunity of revaluation was also given to those candidates, who had not filed the writ petition. Availing the said remedy, petitioner and many other candidates had approached the "Secretary". In compliance of order passed in the matter of Aniruddh Narayan Shukla (supra), "Secretary" has revaluated the answer books of petitioners as well as other candidates and declared the result. Even after that petitioner and many other candidates were not satisfied with revaluation and their result, therefore, they have preferred the present writ petition and many other petitions.
There are also many other candidates, who could not approach the "Secretary" in lack of knowledge of judgment of Aniruddh Narayan Shukla (supra), have also approached this Court being unsatisfied with the evaluation after comparing the scanned answer book with model answer key.
All writ petitions are clubbed and this writ petition (Writ A No. 6420 of 2019) is treated as leading writ petition, which was heard by the Court first time on 25.4.2019 and Court has passed different orders from time to time seeking certain instructions as well as issuing certain directions about this petition and all other connected petitions. Ultimately, today, learned Additional Advocate General has produced a letter dated 19.10.2019 written by Special Secretary, Government of U.P. to the "Secretary". In that letter, it is stated that State Government has taken decision to revaluate the answer book of all petitioners, who are before the Court and declare fresh result. The content of letter dated 19.10.2019 is being quoted here;

2- उक्त के क्रम में सहायक अध्यापक भर्ती परीक्षा-2018 के संबंध में मा0 उच्च न्यायालय इलाहाबाद में योजित याचिका सं0 6420/2019 नरेन्द्र कुमार चतुर्वेदी बनाम उ0प्र0 राज्य व अन्य के साथ सम्बद्ध याचिकाओ में पारित आदेश दिनांक 27-09-2019 के समादर में सम्यक विचारोपरान्त यह निर्णय लिया गया है कि मा0 उच्च न्यायालय में योजित रिट याचिकाये जो पुनर्मूल्यांकन से संबंधित हैं, में अन्तर्ग्रस्त समस्त याचीगणों की उत्तर पुस्तिकाओं का पुनर्मूल्यांकन कराया जायेगा।
3- उक्त के क्रम में मुझे यह कहने का निदेश हुआ है कि कृपया तत्काल मुख्य स्थायी अधिवक्ता, मा0 उच्च न्यायालय इलाहाबाद से सम्पर्क कर प्रश्नगत प्रकरण में समयान्तर्गत अग्रतर कार्यवाही किया जाना सुनिश्चित करें तथा कृत कार्यवाही से शासन को भी अवगत करायें।

Learned Additional Advocate General next submits that in light of decision taken by State Government, all petitions are rendered infructuous and may be dismissed accordingly.
Sri R.K. Ojha, learned senior counsel for the petitioner submits that "Secretary" may be directed to conduct revaluation in accordance with the direction issued by this Court in the matter of Aniruddh Narayan Shukla (supra) as well as in Writ-A No. 5365 of 2019-Radha Devi and others Vs. State of U.P. affirmed in Special Appeal Defective No. 756 of 2019 (State of U.P. and others Vs. Radha Devi and others), vide order dated 20.8.2019.
Learned Additional Advocate General submits that he has no objection to the prayer made by Sri R.K. Ojha, learned senior counsel for the petitioner, but so far as the judgement in the matter of Radha Devi (supra) is concerned, State Government is likely to file Special Leave Petition (hereinafter referred to as SLP) before Apex Court against the same and in case some order is passed in favour of State Government, judgement of Radha Devi (supra) may be taken into consideration in accordance with that while revaluating the answer books.
In view of aforesaid decision taken by the State Government, present petition is disposed of with direction to Secretary, Examination Regulatory Authority, U.P. Allahabad to conduct the revaluation of answer book of petitioner in this petition as well as in all connected writ petitions within a period of three months from today strictly in accordance with guidelines issued by this Court in the matter of Aniruddh Narayan Shukla (supra) as well as Radha Devi (supra).
Needless to say that in case some order is passed by the Apex Court in SLP in the matter of Radha Devi (supra), same shall be abide by the "Secretary" while conducting the revaluation.
Petitioners are also directed to submit copy of this order along with application in the office of "Secretary" within a period of one month from today to avoid any confusion in revaluation of their answer books.
After revaluation of answer sheet and declaration of result, "Secretary" is directed to send the result to concern State authority for issuance of appointment letter against the remaining 22211 post of Assistant Teacher as per marks obtained by the petitioner as well as minimum cut off marks within four weeks from the date of declaration of result.
