                          WP No.29037 of 2018

ORDER:

This writ petition is filed seeking to issue a writ of mandamus to declare the action of the respondents 1 and 2 in not taking any action pursuant to the complaint lodged by the petitioner on 18-07-2018 against the unofficial respondents 3 and 4 as being illegal, arbitrary and for issuance of appropriate consequential directions.

Heard learned counsel for the petitioner and the learned Asst. Government Pleader for Home.

Learned Asst. Government Pleader for Home submits after receipt of petitioner's complaint sent by post alleging that respondents 3 and 4 have illegally mutated their names in the revenue records though the petitioner is the owner of the land in question by virtue of a registered sale deed, an entry was made in the general dairy and a letter was addressed to the petitioner to prove his identity with necessary documents, but the petitioner did not turn up to the Police station and if the petitioner approaches the respondent-Police with necessary documents, steps as per law will be taken. 2

Recording the submission of the learned Asst. Government Pleader for Home, it is open for the petitioner to approach the respondent-Police with necessary documents in support of his allegations against the un-official respondents and in such an event the respondent-Police to taken action on the complaint of the petitioner in the light of the guidelines of the Supreme Court detailed in LALITHA KUMARI vs. GOVERNMENT OF UTTAR PRADESH's case. (2014) 2 SCC 1). The writ petition is disposed of accordingly. Miscellaneous petitions if any pending shall stand disposed of. There shall be no order as to costs.
