1. By way of present petition filed under Article 226 of the Constitution of India, the petitioner seeks directions for being released on furlough for a period of three weeks.
2. Learned counsel for the petitioner contends that the impugned order has been passed without taking note of the order dated 17.11.2023 passed by this Court in W.P.(Crl.) 3127/2023, whereby petitioner was released on furlough for a period of three weeks. It is further submitted that there is no other hindrance in the petitioner being released on furlough except for the reasons stated in the impugned order. It is also stated that petitioner had earlier surrendered in time.
3. Mr. Lao, learned Standing Counsel for the State, on instructions, states that nominal roll of the petitioner is available on record. As per the nominal roll, petitioner has been released thrice on parole which concession he has not misused and his jail conduct is also stated to be satisfactory.

Considering the aforesaid, the petition is allowed and the petitioner is directed to be released on furlough for a period of three weeks from the date of his release, subject to his furnishing a personal bond in the sum of Rs.10,000/- with one surety in the like amount to the satisfaction of the Jail Superintendent and subject to the further following conditions :-
(i) During the period the petitioner remains out on furlough, he shall report to the SHO, Police Station IP Estate, Delhi on every Saturday.
(ii) The petitioner shall also provide the SHO, Police Station IP Estate, Delhi, with a mobile telephone number which shall be kept in working condition at all times and shall not switch off or change the mobile number without prior intimation to the SHO concerned. The mobile location be kept on at all times.
(iii) The petitioner shall not indulge in any criminal activity and shall not communicate with or come in contact with the complainant/victim/survivor or any member of the complainant/victim/survivor's family or tamper with the evidence of the case.
(iv) The petitioner is directed to surrender before the Jail Authorities at the expiry of the period of parole on or before 4:00 PM.
5. Petition is disposed of in the above terms.
6. Copy of the order be communicated to the concerned Jail Superintendent for information and necessary compliance.
