Section 3(1) in The Maharashtra Housing and Area Development Authority Employees Gratuity Regulations, 1985
(1)Subject to the provisions of these regulations, gratuity shall be paid to every employee or, in case of his death, to his nominee or, in the absence of any nomination, to his heir.
