                         JUDGMENT

1. Vide this judgment, I shall dispose off the petition filed under section 372 of the Indian Succession Act, 1925 for obtaining succession certificate in respect of investments/debts/securities etc of Late Mr. Shiv Charan @ Shiv Charan Dass Aggarwal @ Shiv Page No. 2/11 SCC No. 26/19 Pawan Kumar Aggarwal & Ors. Vs. State & Ors.

Date of Decision: 17.09.2019 Charan Dass Agarwal (hereinafter referred as "the deceased").

2. The relevant facts for disposal of the present petition are that the deceased Mr. Shiv Charan @ Shiv Charan Dass Aggarwal @ Shiv Charan Dass Agarwal has expired on 14.10.2018. The deceased was the father of all the three petitioners. It is further pleaded that the deceased had not executed any will and thus there is no impediment in grant of succession certificate in respect of above said debts, securities and insurance policies. Hence, the present petition has been filed by the petitioner for issuing succession certificate regarding all the debts/securities of the deceased.

3. General public was served through publication in daily newspaper 'Vir Arjun' dated 02.04.2019, but none appeared from general public to oppose or contest the present petition.

4. The report regarding legal heirs of the deceased has been filed on behalf of Sh. Prem Chand, Executive Magistrate, Saraswati Vihar, Delhi. As per the said report, the following are the legal heirs of the deceased:­ S. No. Name Relations

7. The petitioners further examined the petitioner no. 3 Sh. Neeraj Gupta vide affidavit Ex. PW3/1. He has relied upon the copy of his aadhar card (Ex. PW3/A) as well as documents already exhibited by the PW­1.

8. The petitioners further examined Sh. Pramod Kumar, Deputy Manager, HDFC Bank, Asaf Ali Road as RW­1. He has brought the statement of saving account bearing no. 05981330008523 of the deceased Mr. Shiv Charan Dass Aggarwal which was exhibited as Ex. RW1/A (Colly). As per record, there is a total sum of Rs. 61,331/­.

9. The petitioners further examined Sh. Narender Bhushan, Officer, Bank of India, Asaf Ali Road as RW­2. He has brought the statement of saving account bearing no. 600110110000186 of Mr. Shiv Charan Dass Aggarwal which was exhibited as Ex. RW2/A. As per record, there is a total sum of Rs. 13,60,078.57/­.

10. The petitioners further examined Sh. Rajeev Kumar, Senior Executive of M/s Alankit Assignment Limited as RW­3. He has brought the record of client master data having Client ID No. 10105526 of Mr. Shiv Charan Dass Aggarwal along with holding valuation statement as on 06.07.2019 which was exhibited as Ex. RW3/A (Colly, 4 pages).

11. The petitioners further examined the respondent no. 3 Sh. Dhruv Singal as RW­4, respondent no. 4 Sh. Ansh Singal as RW­5 and respondent no. 5 Smt. Anuradha Gupta @ Singhal as RW­6. They all have tendered their no objections vide affidavit Ex. RW4/A, Ex. RW5/A and Ex. RW6/A. They all have deposed that they have no objections, if the succession certificate be issued in favour of all the three petitioners.

12. The petitioners did not examine any other witness and vide order dated 13.09.2019, petitioner's evidence was closed.

13. I have heard the learned counsel for the petitioner and perused the material available on record.

14. Considering the above stated facts, this Court is of the opinion that there is no impediment in grant of Succession Certificate in respect of following debts/securities of the deceased Page No. 5/11 SCC No. 26/19 Pawan Kumar Aggarwal & Ors. Vs. State & Ors.

Pawan Kumar Aggarwal on furnishing of an Indemnity Bond of the same value with one surety of like amount within one month from today.
