Perusal of the record reveals that learned senior counsel Mr. Biren Poddar, has been proposed to be appointed as an Arbitrator to resolve the dispute between the parties vide order dated 12.07.2023 by a co-ordinate Bench of this court. The Registrar General of this court was directed to communicate the order to Mr. Biren Poddar seeking his declaration for the said purpose and the declaration has been furnished by Mr. Poddar.
In view of the above, learned senior counsel Mr. Biren Poddar, is hereby appointed as Arbitrator to resolve the dispute between the parties to this application.
It is expected from the Arbitrator that the arbitration proceeding shall be completed as early as possible and practicable, preferably, within six months from the date of commencement of the arbitration proceeding.
Both the parties, shall co-operate for the hearing before the Arbitrator, and they shall not ask for unnecessary adjournments. The Registrar General of this court is directed to supply a copy of the arbitration application along with annexures and affidavits as well as the order passed by this court to Mr. Biren Poddar.
