1. The petitioners applied for the post of CHO (Community Health Officer) on contractual basis, pursuant to recruitment notification dated 31.08.2020.

2. By way of the present writ petition, the petitioners have raised a grievance that despite being higher in merit, they have been posted outside TSP area, whereas the persons lesser meritorious to them have been given posting in Dungarpur, which is TSP area.

3. Learned counsel for the petitioners argued that as per the terms of the advertisement and the rules governing the field the respondents were required to provide posting to the petitioners on the basis of Merit-cum-preference, as is evident from condition No.15 of the recruitment notification dated 31.08.2020 and the same has not been done.

4. Ms. Vandana Bhansali, learned counsel for the respondent-

State at the outset submitted that true it is, that the petitioners have been asked to discharge their duties outside TSP area, but all the selected candidates have been deployed under an ad-hoc arrangement, as and where required.

While highlighting that petitioners are yet to complete their bridge course, learned counsel for the respondents invited Court's attention towards the order dated 10.05.2021, issued by the Special Secretary, Medical & Health and Project Director, NHM, particularly para No.2 and 6 of the order aforesaid and argued that posting will be given once the State is in a position to hold bridge course for them.

6. Para No.2 and 6 of the order dated 10.05.2021 reads thus:-

Having heard learned counsel for the parties and considering the stand of the Sate that petitioner and other candidates have been deployed to meet with the situation arising on account of spread of COVID-19 and their posting will be given once their bridge course is over, this Court does not find it a case worth warranting interference of this Court.

8. Needless to observe that once the bridge course is over and other candidates are given posting, the same be done in terms of condition No.15 of the recruitment notification dated 31.08.2020.

9. Stay petition also stands disposed of accordingly.
