Shabnam Virk, II (2006) CPJ 1 (SC) = (2006) 4 SCC 74, the allottee had filed an affidavit clearly indicating that she would undertake to abide by all the terms and conditions of allotment letter and the amount indicated therein for allotment of a house. There was nothing to show that the increase was possible only when there was increase in the cost of construction. It was held by this Court that the allottee was liable to pay amount as stipulated in the allotment letter. It was observed :
"It is to be noted that the respondent herself had accepted in the undertaking that she accepted the allotment of the house and undertook to abide by all the terms and conditions of the allotment letter. It is not in dispute that in the allotment letter the figure as demanded has been reflected. That being so the respondent was liable to pay the amount as stipulated in the allotment letter.
As there is no dispute that the respondent had in fact filed an affidavit clearly indicating that she undertook to abide by all the terms and conditions of the allotment letter, the amount indicated in the allotment letter was the amount in respect of the allotment of the house. We find nothing in the quoted clause to show that the increase was possible only when there was an increase in the cost of construction. The clause quoted above does not reflect any such intention of the parties.
27. In our considered opinion, the State Commission as well as National Commission ought to have considered all these aspects . Even if they were of the view that after the amendment of the Act in 1993 and in the light of inclusion of 'housing construction' within the meaning of 'service' in Clause (o) of Section 2(1), the Commission had jurisdiction to deal with and decide dispute relating to deficiency in service under the Act which included the issues raised, it was obligatory on them to consider whether the controversy raised in the proceedings with regard to fixation of price would be justiciable on // 27 // the facts and in the circumstances of the case, particularly in the light of contentions raised by the Board that there was increase in plinth area, ground area and payment of enhanced compensation to land owners. The were also required to consider that the Board does not have land of its own and the land was acquired under the Land Acquisition Act by paying compensation determined in accordance with the provisions of that law. The Commissions also could not ignore the fact that when the advertisement was issued for the purpose of registration of intending purchasers of flats, they were clearly intimated that the price shown was merely a 'tentative price'. Again, when the scheme was altered the intending purchasers were informed that the price was tentative and they would have to pay price finally determined by the Board. They consented and entered into an agreement by giving any undertaking that they would pay the price determined by the Board. When the question of giving possession of flats came up, the Board informed them to pay the remaining amount so that possession could be delivered to them. They made such payment and obtained possession. It was, therefore, contended by the Board that the allottees were stopped from raising the contention that additional amount could not have been recovered from them. It was open to the allottees not to pay the additional amount demanded by the Board and not to take possession. By agreeing to pay the amount and by paying such amount and taking possession, now they want to go to behind the concluded contract between the parties. In our considered opinion, all these questions were required to be gone into by the State Commission as also by the National Commission. The orders passed by the Fora, are, therefore, liable to be set aside."

We are of the view that the dispute regarding price of the house cannot be termed as consumer dispute. Now it is very well settled by the Hon'ble National Commission, in a catena of cases that such dispute does not amount to consumer dispute. In the case of National Consumer Awareness Group (Regd.) Vs. Housing Commissioner, Punjab Housing Development Board, III (1997) CPJ 88 (NC), the National Commission was of the view that "The price is determined by the Board in accordance with the procedure evolved by it and there is no statutory control over the fixation of the price and the same cannot therefore be interfered with. The pricing of flats built by the public authority or plot developed by the authorities is not a consumer dispute." The question was again considered by Hon'ble National Commission in the case of Kartar Singh (supra) and after taking into consideration, the pronouncement of Hon'ble Supreme Court in the case of DDA Vs. Ashok Kumar Bahl & ors., 2002 (7) SCC 135 and also other pronouncements of the Hon'ble Supreme Court, on the subject, including Premji Bhai Parmod & Ors. Vs. DDA, 1980 (2) SCC 129, it was held that it is by now settled law that Consumer Fora cannot go into the question of 'pricing', it also does not amount to 'consumer dispute' as per law laid down by the National Commission, in earlier cases.
9. Learned District Forum has taken into consideration the case of Kartar Singh (supra) and rightly come to the conclusion that question regarding pricing of house or flat cannot be determined by Consumer Forum, being not a consumer dispute."

All these arguments have left no impression upon us. The District Forum, in para no. 10 of its judgment, mentioned:-
"10. xxxx In lack of the Damrikrit construction of the road, the two wheeler vehicle and four wheeler vehicle had to be left unsafe far away from the house on the rugged stones (Gitti) and soil, otherwise they get punchered. Vieving the photographs presented in the case, this affidavit cannot be disbelieved. Therefore, we draw this very conclusion or finding that the opposite party has handed over the possession only according to the scheme, but he has not made the facilities or conveniences available to the customers according to the scheme and on these very issues or points, the claim of the complainant is fit to be admitted".

Where a development authority forms layouts and allots plots/flats (or houses) by inviting applications, the following general principles regulate the granting of relief to a consumer (the applicant for allotment) who complains of delay in delivery or non-delivery and seeks Redressal under the Consumer Protection Act, 1986 ("the Act", for short) (vide Lucknow Development Authority v. M.K. Gupta (1994) 1 SCC 243, Ghaziabad Development Authority v. Balbir Singh (2004) 5 SCC 65 and HUDA v. Darsh Kumar (2005) 9 SCC 449, as also Ghaziabad Development Authority v. Union of India (2000) 6 SCC
113.
(a) Where the development authority having received the full price does not deliver possession of the allotted plot/flat/house within the time stipulated or within a reasonable time, or where the allotment is cancelled or possession is refused without any justifiable cause, the allottee is entitled for refund of the amount paid, with reasonable interest thereon from the date of payment to date of refund. In addition, the allottee may also be entitled to compensation, as may be decided with reference to the facts of each case.
(b) Where no time is stipulated for performance of the contract (that is for delivery), or where time is not the essence of the contract and the buyer does not issue a notice making time the essence by fixing a reasonable time for performance, // 35 // if the buyer, instead of resciding the contract on the ground of non-performance, accepts the belated performance in terms of the contract, there is no question of any breach or payment of damages under the general law governing contracts. However, if some statute steps in and creates any statutotry obligations on the part of development authority in contractural field, the matter will be governed by the provisions of that statute.
(c) Where an alternative site is offered or delivered (at the agreed price) in view of its inability to deliver the earlier allotted plot/flat/house, or where the delay in delivering possession of the allotted plot/flat/house is for justifiable reasons, ordinarily the allottee will not be entitled to any interest or compensation. This is becaue the buyer has the benefit of appreciation in value.
(d) Though the relationship between development authority and an applicant for allotment is that of a seller and buyer, and therefore governed by law of contracts (which does not recognise metnal agony and suffering as a head of damages for breach), compensation can be awarded to the consumer under the head metanl agony and suffering, by applying the principle of administrative law, where the seller being a statutotry authority acts negligently, arbitrarily or capriciously.
(e) .................. (f) .................. (g) Where full payment is made and possession is
delivered, but title deed is not executed without any justifiable cause, the allottee may be awarded compensation, for harassment and mental agony, in addition to appropriate direction for execution and delivery of title deed.
(h) Where the allotment relates to a flat/house and construction is incomplete or not in accordance with the agreed specifications, when it is delivered, the allottee will be // 36 // entitled to compensation equivalent to the cost of completing the building or rectifying the defects.
18. We find that both parties, BDA as also the respondent proceeded on the basis that time was not the essence of the contract. In a contract involving construction, time is not the essence of the contract unless specified. Even when the respondent wrote the letters dated 29-11-1989, 17-1-1990, 9-7-1993 and 11-1-1994, it did not make time for performance of the essence of contract, nor fix any reasonable time for performance. The respondent did not also choose to terminate the contract, obviously in view of the manifold increase in the value of the houses. For the first time, by notice dated 11-7- 1994, it purported to make the time the essence, but demanded delivery within an unreasonable period of one month and filed the complaint on 4-2-1995. Thus, it cannot be said that the respondent made time the essence of contract, in a manner recognised in law. We also find that the Development Authority was constructing these houses under a self-financing scheme on "no-profiti-no-loss basis" by using the instalments/amounts paid by the allottees. The houses were delivered in 1997 at a price agreed in 1986. By 1997, the value had gone up many times (more than 10 times according to BDA). The respondent had the benefit of such rise in value. The respondent also failed to prove any negligence on the part of BDA. In this factual background, we find it difficult to hold that there was "deficiency in service" on the part of BDA entitling the respondent for any compensation by way of interest or otherwise. Consequently, the respondent is not entitled to any compensation."
