Heard Sri Prateek Sinha, learned counsel for the petitioners and Sri Vinayak Nath Singh Advocate holding brief of Sri Kaushalendra Nath Singh, learned counsel for respondent Nos.2 and 3.
The writ petitioners seek a writ of certiorary quashing the show cause notices dated 06.12.2019 and 20.08.2020 issued by the second-respondent. The show cause notices have been issued calling upon the petitioners to stop running commercial activities in the form of nursery play schools in residential area.
Further contention of the learned counsel for the petitioners is that on the basis of the aforesaid show cause notices alone, the petitioners are being threatened and that a reply to the show cause notice has already been filed by the petitioners.
Counsel appearing for NOIDA states that consequent to the show cause notices, no final orders for stopping the alleged commercial activities have been passed till date.
Since the petitioners are stated to have filed their replies to the show cause notices issued to them, this writ petition is disposed of directing NOIDA to pass appropriate orders after considering the replies filed by the petitioners to the show cause notices issued to them, expeditiously and preferably within a period of ten days from a copy of this order is filed before them.
